Development of a new model regulation and its sample

In October 2020, the Ministry of Justice was registered, developed in August 2020 by the Ministry of Labor under number 438n. This document approved the Model Regulation on the Occupational Safety and Health Management System, which officially came into force on October 28, 2020.

OSMS - what is it?

The concept of an OSH management system is given in Article 209 of the Labor Code of the Russian Federation and is defined as a single mechanism of interacting and interconnected elements that establish an employer's policy in the field of OSH. In this regard, the OSMS is assigned the following tasks:

  • security technological processes used by a particular employer, buildings, structures, production equipment;
  • improvement of working conditions for employees in compliance with the optimal regime of work and rest, provision of medical and preventive services;
  • conducting consultations, briefings, training sessions on labor protection, constant work aimed at the literacy of workers in this area and compliance with the basic standards in relation to the specifics of the organization's activities;
  • analysis of the causes of accidents, work injuries, occupational diseases and taking measures to reduce these risks.

The main responsibility for compliance with OSHMS standards rests with the head of the organization. He has the right to allocate an OT specialist or service, assigning functions to them by order and prescribing them in job descriptions. Functions

The system must have a number of functions that must be taken into account when developing, implementing and improving it:

  • assessment of health indicators;
  • planning of activities and work in the field of labor protection;
  • organization of events and their coordination;
  • development, implementation and keeping up to date of regulatory documents on labor protection;
  • organization of training for OT specialists or responsible employees of the organization, with periodic verification of knowledge;
  • control over the state of health and safety and the activities of services, whose work in the organization is aimed at organizing relevant events;
  • keeping records and analysis of current working conditions, causes of accidents at work associated with injuries, occupational diseases;
  • organization of work on investigation of cases industrial injuries;

Stages of OSMS implementation

The main document on the organization and functioning of an OSMS in an organization is the Regulation. It can be developed by both the relevant employer service and third-party organizations. The creation and implementation of the system can be divided into six stages:

Which organizations may not create an OSH management system?

Small businesses often do not consider it necessary to create an SAWS, believing that it is necessary only for production processes and large enterprises where there is a risk of injury. But they are not entirely right due to the following factors:

  • even with a small staff, a process management scheme must be developed. And if you increase it, the system will no longer be as simple as it seems;
  • in any organization, the manager is responsible for occupational safety and must pass special training... Any accident during working hours will be considered for non-compliance with labor protection standards and the manager will be punished accordingly. Therefore, labor protection measures should be carried out even in small organizations;
  • SOUT is necessary even if the staff consists only of office workers and service personnel. Therefore, we should move away from the idea that the hazard exists only in production.

Now let's move on to the question: Is the employer obligated to create a health and safety management system in the organization?

The answer is unequivocal - it is obliged in accordance with Art. 212 of the Labor Code. At the same time, the legislation does not divide employers into large and small business entities, does not establish standards for staffing and other criteria.

Of course, SOUT for small businesses and large entities will differ in the structure of activities and the costs of them. For the former, it is envisaged to draw up a simplified OSH management system and integrate it into their business process.

If an accident occurs in the organization, will the labor inspector ask for an OSHMS regulation?

In the event that an industrial incident with a group of people has occurred in the organization, which has serious consequences or fatal outcome, an unscheduled inspection will be carried out by an employee of the State Labor Inspectorate. It is carried out twice: during the investigation of the accident and after its completion.

An inspector of the State Inspectorate for Inspection may appear for inspection without prior notice within 20 working days. He must request all documents regarding compliance with labor protection requirements, both in relation to the victim and in the organization as a whole. This applies to the provisions on SOUT and personnel documents to establish legality labor relations with the victim:

  • labor contract;
  • T2 cards;
  • time sheets.

All identified violations will be reflected in an act with a prescription and a deadline for their elimination. After the expiration of the period specified in the act, the inspector of the State Inspectorate will again go to the organization for verification and check the fulfillment of the requirements of the act.

An employer who avoids eliminating the identified violations will be fined on the basis of a protocol on administrative offense compiled by the inspector of the State Institute of Technology. Further, the protocol is transferred along with other materials on the investigation to the court.

The fine is from 100 to 200 thousand rubles.

1. GENERAL PROVISIONS

1.1. This Regulation on the OSH management system has been developed in accordance with the following regulatory documents:
Labor Code Russian Federation;
 interstate standard GOST 12.0.230-2007 “Occupational safety standards system. Occupational safety management systems. General requirements»;
national standard RF GOST R 12.0.007-2009 “Occupational safety standards system. Occupational safety management system in the organization. General requirements for development, application, assessment and improvement ”;
 order of the Ministry of Labor and social protection Of the Russian Federation dated August 19, 2016 No. 438n on the approval of the Model Regulations on the OSH management system;
 other regulatory legal acts about labor protection.
1.2. Occupational health and safety management system is part of the management system of the economic activities of the Institution, which ensures the management of professional risks associated with the production activities of employees.
1.3. The governing bodies of the Institution form the Occupational Safety Management System.
1.4. This regulation determines the order and structure of OSH management in the Institution, serves as a legal, organizational and methodological basis for the formation of management structures, regulatory documents.
1.5. The object of management is labor protection, as a system for preserving the life and health of workers in the process of working, including legal, socio-economic, organizational and technical, sanitary and hygienic, treatment and prophylactic, rehabilitation and other measures.

2. EMPLOYER POLICIES IN THE FIELD OF LABOR PROTECTION

2.1. The main principles of the OSH management system in the Institution are:
 ensuring the priority of preserving the life and health of employees and individuals in the process of their work and organized recreation;
 guarantees of workers' rights to labor protection;
 activities aimed at the prevention and prevention of industrial injuries and occupational morbidity;
 Ensuring compliance with labor protection requirements contained in the legislation of the Russian Federation, industry-specific labor protection rules, as well as in the safety, sanitary and building codes and the rules state standards, organizational and methodological documents, instructions on labor protection for the creation of healthy and safe working conditions;

3. OBJECTIVES OF THE EMPLOYER IN THE FIELD OF LABOR PROTECTION

3.1. The employer's objectives in the field of labor protection are:
 providing legal rights and the employee's interests in working conditions that meet regulatory requirements;
 optimization of financial, material and social costs to ensure labor conditions and safety;
 compliance of the provided services of the Institution with the established safety requirements.
3.2. The main goals in the field of labor protection are contained in the Labor Protection Policy and are achieved by the employer implementing the procedures provided for in Section 5 of this Regulation:

4.1. The structure of the OSH management system
4.1.1. Organizationally, the OSH management system is three-tier.
4.1.2. Occupational safety management at the first level, in accordance with the existing powers, is carried out by the employer represented by the head physician of the Institution.
4.1.3. Occupational safety management at the second level, in accordance with the existing powers, is carried out by an occupational safety specialist.
4.1.4. Occupational safety management at the third level, in accordance with the existing powers, is carried out by the Occupational Safety Commission.
4.1.5. The procedure for organizing labor protection work in the Institution is determined by its Charter, Internal Labor Regulations, job descriptions, labor protection instructions and in accordance with the requirements of this Regulation.
4.2. Functions of the Chief Physician of the Institution in the implementation of labor protection management
4.2.1. The Chief Physician of the Institution in the manner prescribed by law:
 carries out general management labor protection at the Institution;
 ensures compliance with the applicable labor legislation, execution of decisions and orders higher authorities, regulatory (legal) documents on labor protection issues, orders of bodies state supervision and control, decisions of the labor collective, the collective agreement in terms of labor protection;
 organizes work to create and ensure working conditions in accordance with current legislation on labor, intersectoral and departmental regulations and other local acts on labor protection and the Charter of the Institution;
 provides safe operation buildings and structures, engineering and technical communications, equipment and takes measures to bring them in line with applicable standards, rules and regulations for labor protection. Organizes inspections and repairs of buildings (premises) in a timely manner;
 approves job responsibilities for ensuring labor protection and instructions on labor protection for employees of the Institution;
 ensures the development and implementation of plans of measures for labor protection, target programs for labor protection;
 takes measures to implement the proposals of the team aimed at further improving and improving working conditions;
 submits for discussion of production meetings and meetings of the labor collective the issues of organization of work on labor protection;
 reports at meetings of the labor collective on the state of labor protection, the implementation of measures to improve working conditions, as well as measures taken to eliminate the identified deficiencies;
 provides funding for labor protection measures, organizes the provision of employees of the Institution with overalls, special footwear and other personal protective equipment in accordance with the current model norms and instructions, as well as persons undergoing industrial practice, in the conduct of socially useful and productive labor, etc.;
 rewards employees of the Institution for active work to create and ensure healthy and safe working conditions;
 engages in disciplinary responsibility persons guilty of violating labor legislation, rules and regulations on labor protection;
 carries out preventive work to prevent injuries and reduce the incidence of sickness among workers, persons undergoing industrial practice;
 supervises the timely conduct of prophylactic medical examination of employees;
 ensures the fulfillment of the requirements of the current regulatory documents on labor protection, instructions of the governing bodies, state supervision and technical labor inspection;
 provides the necessary conditions for conducting a timely and objective investigation of accidents at work in accordance with the current legislation;
 approves, in agreement with the trade union, instructions on labor protection;
 organizes an introductory briefing on labor protection with newly hired persons, briefing and training at the workplace for employees of the Institution;
 plans, in accordance with the established procedure, training on labor protection of employees of the Institution;
 ensures the workload of workers, taking into account their psychophysical capabilities, organizes optimal work and rest regimes;
 stops production activity if there is a threat to the health of workers involved in it;
 provides payment sick leave incapacity for work and additional payment to persons working in unfavorable conditions labor;
 carries personal responsibility for ensuring healthy and safe working conditions at the Institution.
4.3. Occupational safety specialist
4.3.1. The occupational safety specialist reports directly to the head physician of the Institution.
4.3.2. The labor protection specialist carries out his activities in cooperation with the labor protection commission.
4.3.3. The labor protection specialist in his activities is guided by laws and other regulatory legal acts on protection, agreements (industry), collective agreement, labor protection agreement, other local regulatory legal acts of the Institution.
4.3.4. The main tasks of a labor protection specialist are:
 organization of work to ensure that employees comply with labor protection requirements;
 control over the observance by employees of laws and other regulatory legal acts on labor protection, collective agreement, labor protection agreement, and other local regulatory legal acts of the Institution;
 organization preventive work to prevent industrial injuries, occupational diseases and diseases caused by production factors, as well as work to improve working conditions;
 ensuring the work of the labor protection office, equipping it with the necessary aids, teaching aids, etc .;
 development of new and revision of outdated labor protection instructions;
 control over the issuance of overalls, special footwear and other necessary personal protective equipment to workers engaged in production with harmful and (or) hazardous working conditions, as well as at work associated with pollution or performed in adverse temperature conditions;
 control over the timely provision of workers with flushing agents in accordance with the established norms;
 control over the timely conduct of a special assessment of working conditions, certification of sanitary technical condition working conditions, development and implementation, based on their results, of measures to bring working conditions and labor protection in accordance with regulatory requirements;
 study and dissemination of advanced experience in labor protection, promotion of labor protection issues.
4.3.5. To accomplish the assigned tasks, the OSH specialist is assigned the following functions:
 accounting and analysis of the state and causes of industrial injuries, occupational diseases and diseases caused by industrial factors;
 rendering assistance to subdivisions in organizing and carrying out measurements of parameters of hazardous and harmful production factors, in assessing injury safety of equipment and devices;
 organization, methodological guidance special assessment working conditions, certification of labor protection works and control over their implementation;
 Carrying out inspections, examinations of the technical condition of buildings, structures, equipment, machines and mechanisms, devices, personal protective equipment for workers, the condition of sanitary devices, the operation of ventilation systems for compliance with labor protection requirements;
 development of programs to improve labor conditions and safety, prevention of industrial injuries, occupational diseases, diseases caused by industrial factors; provision of organizational and methodological assistance in the implementation of planned activities;
 participation in the drafting of the sections of the collective agreement concerning labor conditions and labor protection;
 participation in the work on the compilation of lists of positions, according to which employees must undergo mandatory preliminary and periodic medical examinations, as well as positions entitled to benefits and compensation for work in harmful or hazardous working conditions;
 participation in the work of the commission for the investigation of accidents;
 execution and storage of documents related to labor protection requirements in accordance with the established deadlines;
 participation in the preparation of documents for the appointment of insurance payments in connection with industrial accidents or occupational diseases;
 Drawing up reports on labor protection and working conditions in accordance with the forms established by the State Statistics Committee of Russia;
 development of training programs on labor protection;
 conducting introductory briefing on labor protection with all persons entering work, business travelers, undergoing industrial practice;
 control over the provision and correct use of individual and collective protective equipment;
 organization of timely training on labor protection of employees of the Institution, including the chief physician, participation in the work of commissions to test knowledge of labor protection requirements;
 providing officials, structural divisions of the Institution with local regulatory legal acts, visual aids and educational materials on labor protection;
 organization of meetings on labor protection;
 bringing to the attention of employees existing laws and other regulatory legal acts on labor protection of the Russian Federation, a collective agreement, an agreement on labor protection in the Institution;
 control over the implementation of measures provided for in programs, plans to improve working conditions and labor protection, the section of the collective agreement concerning labor protection issues, an agreement on labor protection, as well as over the adoption of measures to eliminate the causes that caused an accident at work, compliance with the instructions of state bodies supervision and control over compliance with labor protection requirements, other measures to create safe working conditions;
 control over the timely conduct of the necessary tests and technical examinations of equipment, machines and mechanisms by the relevant services;
 control over the organization of storage, distribution, washing, dry cleaning, drying, degreasing and repair of special clothing, special footwear and other means of individual and collective protection;
 control over the correct spending of funds allocated for the implementation of measures to improve labor conditions and safety;
 control over the use of labor by women and persons under the age of 18 in accordance with the legislation of the Russian Federation;
 consideration of letters, applications, complaints of employees regarding labor conditions and safety, preparation of proposals to the head physician of the Institution to eliminate the identified deficiencies.
4.4. Labor Protection Commission
4.4.1. The Occupational Safety Commission (hereinafter - the Commission) is an integral part of the Occupational Safety Management System of the Institution.
4.4.2. The work of the Commission is based on the principles of social partnership.
4.4.3. The Commission interacts with state bodies of labor protection management, bodies of the federal labor inspection, other state bodies of supervision and control.
4.4.4. The Commission in its activities is guided by the laws and other regulatory legal acts of the Russian Federation, the collective agreement, and other local regulatory legal acts of the Institution.
4.4.5. The tasks of the Commission are:
 development, based on the proposals of the members of the Commission, a program of joint actions of the chief physician of the Institution, trade union to ensure labor protection requirements, prevention of industrial injuries, occupational diseases;
 organization of inspections of the state of labor conditions and labor protection at workplaces, preparation of relevant proposals to the employer on solving labor protection problems based on an analysis of the state of labor conditions and labor protection, industrial injuries and occupational morbidity;
 informing employees about the state of working conditions and labor protection at workplaces, the existing risk of damage to health and about compensations due to employees for work in harmful and hazardous working conditions, personal protective equipment.
4.4.6. The functions of the Commission are:
 Consideration of proposals of the employer, employees, trade union for the development of recommendations aimed at improving the conditions and labor protection of employees;
 participation in conducting surveys of the state of labor conditions and labor protection in the Institution, reviewing their results and developing recommendations for the employer to eliminate the identified violations;
 informing the employees of the Institution about the measures taken to improve working conditions and safety, prevention of industrial injuries, occupational diseases;
 bringing to the attention of the employees of the Institution the results of a special assessment of working conditions;
 assistance in organizing preliminary and periodic medical examinations upon admission to work and adherence to medical recommendations during employment;
 participation in the consideration of issues of financing measures for labor protection, mandatory social insurance from industrial accidents and occupational diseases;
 preparation and submission to the employer of proposals for improving work on labor protection and preserving the health of employees;
 Consideration of draft local regulatory legal acts on labor protection and preparation of proposals on them to the employer, trade union elected body.
4.5. Organization of work to ensure labor protection
The organization of work on labor protection provides for:
 distribution of duties and responsibilities for labor protection between the management and personnel of the Institution;
 participation of employees and their representatives in labor protection management;
 education and training of employees;
 development of procedures for the formation of documentation for the OSH management system;
 development of a process for collecting and transmitting information on labor protection.
4.5.1. Distribution of duties and responsibilities for labor protection
4.5.1.1. The role of the Chief Physician of the Institution in OSH management is aimed at creating an effective OSH management system. She allows him to:
 define goals;
 allocate priority goals / objectives and necessary resources;
 facilitate work planning;
 provide the employee with all the necessary information about the dangers he may face during work. If an employee at his workplace may come into contact with hazardous substances and materials, at his disposal should be information about all the dangerous properties of these substances and measures for their safe handling;
 organize work to ensure labor protection;
 increase the motivation of personnel to fulfill common goals and objectives to ensure labor protection;
 provide the necessary conditions and resources for persons responsible for ensuring labor protection, including members of the commission and an authorized person for labor protection of the trade union.
4.5.1.2. Deputy Chief Physician for Economic Affairs:
 organizes work on compliance with the norms and rules of labor protection in the production process;
 provides control over the safety of equipment, instruments, technical and visual aids of the production process used in the production process;
 controls the timely conduct of briefing of employees, persons undergoing industrial practice, its registration in the journal;
 Carries out, together with the trade union, administrative and public control over the safety of use, storage of equipment and other means involved in production activities. Timely takes measures to seize equipment, devices not provided for in the standard lists, including homemade ones, installed in premises without an appropriate permit act, suspends manufacturing process in the premises of the Institution, if there are dangerous conditions for the health of employees, persons undergoing industrial practice;
 reveals the circumstances of accidents that have occurred with employees, persons undergoing industrial practice.
 ensures compliance with labor protection requirements during the operation of the main building and premises of the Institution, technological, power equipment, and implements them periodic inspection and organizes Maintenance;
 ensures safety when carrying heavy loads, loading and unloading operations, operation Vehicle Institutions;
 monitors compliance with requirements fire safety buildings and structures, monitors the serviceability of fire extinguishing equipment;
 provides premises with equipment and implements that meet the requirements of the rules and regulations of labor protection, labor safety standards;
 organizes periodic measurements of the insulation resistance of electrical installations and wiring, grounding devices, periodic tests and surveys of hot water and steam boilers, pressure vessels, analysis air environment for the content of dust, gases and vapors harmful substances, measuring the illumination of the presence of radiation, noise in the premises of the Institution in accordance with the rules and regulations for ensuring labor protection;
 organizes training, conducts on-the-job briefings (primary, repeated, unscheduled and targeted) technical and service personnel;
 purchases, according to the application, overalls, safety footwear and other personal protective equipment for employees of the Institution and persons undergoing industrial practice;
 provides accounting, storage of fire-fighting equipment, drying, washing, repair and disinfection of workwear, special footwear individual funds protection.
 ensures the introduction into production of new, safer technological processes and equipment developed taking into account the latest scientific and technological achievements, best practices and labor safety standards, as well as the introduction of inventions, rationalization proposals, research and development developments that ensure an increase in the safety of work;
 participates in the consideration of projects for new technological processes, construction and reconstruction of facilities overhaul buildings and structures;

4.5.1.3. Head of the structural unit of the Institution:
 takes measures to increase the responsibility of the employees of the unit for compliance with the norms and rules of labor protection and labor discipline, for the timely implementation of the planned measures for labor protection, instructions of the state supervision bodies;
 Carries out organizational and technical management in the division of work on labor protection in accordance with the current labor legislation;
 participates in drawing up a plan of measures for labor protection in the unit;
 participates in meetings to consider issues of the state of labor protection in the unit;
 monitors compliance with labor protection requirements by subordinate personnel;
 ensures the implementation of plans of measures for labor protection, target programs for labor protection.
4.5.1.4. Chief Accountant:
 monitors the targeted spending of funds allocated for labor protection;
 Carries out accounting records of the expenditure of funds for the implementation of measures provided for by collective agreements, plans of measures for labor protection;
 controls the correctness of the provision of compensations for working conditions to employees;
 Keeps track of expenses in connection with accidents, accidents, occupational diseases, payment of fines by decision government agencies supervision and control;
 participates in drawing up a plan of measures for labor protection;
 participates in meetings to consider issues of the state of labor protection.
4.5.1.5. Obligations of employees.
Employees of the Institution are obliged to:
 use safe work methods;
 comply with labor protection requirements established by laws and other regulatory legal acts, these Regulations, correctly apply means of individual and collective protection, perform other duties provided for by current legislation;
 undergo training in safe methods of performing work, instruction on labor protection, internship at the workplace, testing of knowledge of labor protection requirements;
 notify the direct supervisor about a situation that threatens the life and health of people, about every accident that occurs at work, or about the deterioration of his health;
 undergo compulsory medical examinations;
 actively participate in the activities of the Office to ensure labor protection.
4.5.2. Training and education of personnel on labor protection.
4.5.2.1. Training and testing of knowledge of labor protection requirements.
Labor protection training and testing of knowledge of labor protection requirements of all employees are carried out in order to provide preventive measures to reduce industrial injuries and occupational diseases. Responsibility for the organization and timeliness of training on labor protection and verification of knowledge of labor protection requirements of employees bears chief physician Institutions in the manner prescribed by the legislation of the Russian Federation.
4.5.2.2. Occupational safety training includes:
 introductory briefing;
 on-the-job instruction: primary, repeated, unscheduled and targeted;
 training of workers in blue-collar occupations;
 training of managers and specialists, as well as training of other individual categories insured under the compulsory social insurance system.
4.5.2.3. All hired persons, as well as employees sent to the Institution, undergo introductory briefing in the prescribed manner.
4.5.2.4. Introductory briefing on labor protection is carried out according to a program developed on the basis of legislative and other regulatory legal acts of the Russian Federation, taking into account the specifics of the activities of the Institution.
4.5.2.5. Primary, repeated, unscheduled and targeted briefings at the workplace are carried out by an official who has undergone training in labor protection in accordance with the established procedure and tested knowledge of labor protection requirements, appointed by order of the chief physician.
4.5.2.6. Conducting briefings on labor protection includes familiarizing employees with existing hazardous or harmful production factors, studying labor protection requirements contained in the local regulations of the Institution, instructions on labor protection, technical, operational documentation.
4.5.2.7. The briefing on labor protection is completed by verbal verification of the knowledge and skills of safe work practices acquired by the employee by the person who instructed.
4.5.2.8. All types of briefings are recorded in the appropriate briefing logs, indicating the signatures, instructed and instructed, as well as the date of the briefing.
4.5.2.9. Initial instruction at the workplace is carried out before the start of independent work:
 with all newly hired employees;
 with employees transferred in accordance with the established procedure from another structural unit, or employees who are entrusted with the performance of a new job for them.
4.5.2.10. Primary instruction at the workplace is carried out by the heads of the structural units of the Institution according to programs developed and approved in accordance with the established procedure in accordance with the requirements of legislative and other regulatory legal acts on labor protection, local regulations of the organization, instructions on labor protection, technical and operational documentation.
4.5.2.11. Employees who are not associated with the operation, maintenance, testing, adjustment and repair of equipment, the use of electrified or other tools, storage and use of raw materials and materials, may be exempted from primary instruction at the workplace. The list of professions and positions of employees exempted from primary instruction at the workplace is approved by the head physician of the Institution.
4.5.2.12. All employees undergo re-training at least once every 6 months in accordance with programs developed for initial training at the workplace.
4.5.2.13. Unscheduled briefing is carried out by:
 upon enactment of new or amendments to legislative and other normative legal acts containing labor protection requirements, as well as instructions on labor protection;
 when changing technological processes, replacing or modernizing equipment, fixtures and other factors affecting labor safety;
 in case of violation by employees of labor protection requirements, if these violations have created a real threat of the onset of grave consequences (accident, accident, etc.);
 at the request of officials of state supervision and control bodies;
 by the decision of the head physician of the Institution.
4.5.2.14. Targeted briefing carried out when performing one-time work, eliminating the consequences of accidents, natural Disasters and works for which a permit, permit or other special documents are drawn up, as well as during mass events.
4.5.3. Workplace internship.
4.5.3.1. Before admission to independent work, all employees, except for positions exempted from primary briefing at the workplace, undergo an internship at the workplace.
4.5.3.2. The duration of the internship is set depending on the nature of the work (specialty, position) and can range from 2 to 14 shifts.
4.5.3.3. The internship ends with a test of the knowledge of labor protection and the acquired skills of safe ways of working. The result of the internship is recorded in the register of instruction on labor protection at the workplace.
4.5.4. Training for managers and specialists.
4.5.4.1. The managers and specialists of the Institution undergo special training in labor protection in the scope of their job duties upon admission to work during the first month, then - as necessary, but at least once every three years.
Newly appointed managers and specialists of the Institution are admitted to independent activity after reading them job responsibilities, including on labor protection, with the local regulations in force in the Institution governing the procedure for organizing labor protection work.
4.5.4.2. Occupational safety training in specialized educational organizations is carried out:
 chief physician of the Institution;
 Deputy Chief Physicians responsible for working conditions and labor protection at the Institution;
 labor protection specialist;
 heads of all structural divisions;
 specialists of the Institution, in accordance with the order of the director.
4.5.5. Testing knowledge of labor protection requirements.
4.5.5.1. Testing theoretical knowledge of labor protection requirements and practical skills without dangerous work workers of blue-collar occupations are carried out by direct supervisors of work in the amount of knowledge of the requirements of rules and instructions for labor protection, and, if necessary, in the amount of knowledge of additional special requirements for safety and labor protection.
4.5.5.2. The managers and specialists of the Institution (referred to in clause 4.5.4.2) undergo a regular test of their knowledge of labor protection requirements at least once every three years.
4.5.5.3. An unscheduled examination of the knowledge of the labor protection requirements of personnel of the Institutions, regardless of the period of the previous inspection, shall carry out:
 when introducing new or introducing amendments and additions to existing legislative and other normative legal acts containing labor protection requirements. At the same time, only the knowledge of these legislative and regulatory legal acts is tested;
 when commissioning new equipment and changes in technological processes that require additional knowledge of workers' labor protection. In this case, the knowledge of labor protection requirements associated with the relevant changes is checked;
 when appointing or transferring employees to another job, if new duties require additional knowledge of labor protection;
 at the request of officials of the federal labor inspectorate, other bodies of state supervision and control, as well as federal authorities executive power and regional bodies the executive power in the field of labor protection, as well as the head physician of the Institution in the event of violations of labor protection requirements and insufficient knowledge of labor safety and protection requirements;
 after accidents and accidents that have occurred, as well as upon detection of repeated violations by employees of the requirements of regulatory legal acts on labor protection;
 in case of a break in work in this position for more than one year.
The scope and procedure for the procedure for an extraordinary test of knowledge of labor protection requirements is determined by the party initiating its implementation.
4.5.5.4. To test the knowledge of labor protection requirements of employees, by order of the head physician of the Institution, a commission is created to test knowledge of labor protection requirements, consisting of at least 3 people who have undergone training in labor protection and tested knowledge of labor protection requirements in the prescribed manner.
4.5.5.5. The commission for testing the knowledge of labor protection requirements includes: the deputy chief physician, heads of structural divisions, an occupational safety specialist, representatives of the trade union.
4.5.5.6. The results of testing the knowledge of labor protection requirements of workers are documented in a protocol.
4.5.5.7. An employee who has not passed the knowledge test of labor protection requirements during training is then obliged to re-test his knowledge within a period of no later than one month.

5. PROCEDURES AIMED TO ACHIEVE THE EMPLOYER'S OBJECTIVES IN THE FIELD OF LABOR PROTECTION

5.1. To achieve the goals of the employer in the field of labor protection, the Institution establishes (enters into force):
 Requirements for the necessary professional competence for labor protection of workers, its verification, maintenance and development;
 a list of professions (positions) of employees undergoing occupational safety training, indicating its duration for each profession (position);
 a list of professions (positions) of workers undergoing training in labor protection in training organizations, admitted to the provision of services in the field of labor protection;
 list of professions (positions) of employees undergoing occupational safety training at the employer;
 a list of professions (positions) of workers exempted from primary instruction at the workplace;
 employees responsible for training on labor protection at the workplace in the structural units of the employer, for training on labor protection;
 Issues included in the OSH briefing program;
 the composition of the employer's commission to test the knowledge of labor protection requirements;
 regulations on the work of the employer's commission for testing the knowledge of labor protection requirements;
 a list of issues on labor protection, on which employees are tested for knowledge in the employer's commission;
 the procedure for organizing training in the provision of first aid to victims of accidents and accidents at work;
 the procedure for organizing and conducting briefing on labor protection;
 the procedure for organizing and conducting internships at the workplace and training in labor protection.
5.2. In the course of organizing the procedure for training workers in labor protection, the need to train workers is taken into account based on the nature and content of the work they perform, their qualifications and competencies necessary for the safe performance of their job duties.
5.3. In order to organize the procedure for organizing and assessing working conditions, the following are established:
 the procedure for the creation and functioning of the commission for conducting a special assessment of working conditions, as well as the rights, duties and responsibilities of its members;
 the peculiarities of the functioning of the commission for carrying out a special assessment of working conditions in the presence of the employer of separate structural divisions;
 organizational procedure for conducting a special assessment of working conditions at the employer's workplace in terms of the activities of the commission for conducting a special assessment of working conditions;
 the procedure for selecting and concluding a civil law contract with an organization that conducts a special assessment of working conditions, taking into account the need to involve in this work the most competent employer in relation to the type of activity;
 procedure for settling disputes on issues of a special assessment of working conditions;
 the procedure for using the results of a special assessment of working conditions.
5.4. In order to organize the procedure for managing professional risks in the Institution, the procedure for implementing the following measures for managing professional risks is established (determined):
 identification of hazards;
 assessment of the levels of professional risks;
 reducing the levels of professional risks.
5.5. Methods for assessing the level of professional risks are determined by the employer, taking into account the nature of their activities and the complexity of the operations performed. It is allowed to use different methods for assessing the level of professional risks for different processes and operations.
5.6. When describing the professional risk management procedure, the following is taken into account:
 professional risk management is carried out taking into account the current, past and future activities of the employer;
 the severity of possible damage increases in proportion to the increase in the number of people at risk;
 all assessed professional risks are subject to management;
 procedures for identifying hazards and assessing the level of professional risks should be constantly improved and maintained in working order in order to ensure the effective implementation of measures to reduce them;
 The effectiveness of the developed measures to manage professional risks should be constantly assessed.
5.7. Measures to eliminate or reduce the levels of professional risks include:
 elimination of hazardous work (procedures);
 replacement of hazardous work (procedure) with less hazardous;
 implementation of engineering (technical) methods to limit the risk of exposure to hazards to workers;
 implementation administrative methods limiting the time of exposure of workers to hazards;
 use of personal protective equipment;
 professional risk insurance.
5.8. In order to organize the procedure for organizing and conducting monitoring of the health status of employees in the Establishment, it is established:
 the procedure for implementing both mandatory (by virtue of the provisions of regulatory legal acts) and on a voluntary basis (including on the proposals of employees authorized by them representative bodies, committee (commission) on labor protection) medical examinations, psychiatric examinations, chemical and toxicological studies of workers;
 a list of professions (positions) of employees that are subject to medical examinations, psychiatric examinations, chemical and toxicological studies.
5.9. In order to organize the procedure for informing employees about the working conditions at their workplaces, the levels of occupational risks, as well as about the guarantees provided to them, the relying on compensations, the Establishment establishes the forms of such information and the procedure for their implementation.  use of information resources in the information and telecommunication network "Internet";
 posting relevant information in public places.
5.10. In order to organize the procedure for ensuring optimal work and rest regimes for employees in the Institution, measures are determined to prevent the possibility of injury to employees, their morbidity due to overwork and the impact of psychophysiological factors. Measures to ensure optimal work and rest regimes for employees include:
 ensuring the rational use of working time;
 organization of shift work, including work at night;
 provision of in-shift breaks for workers' rest, including breaks to create favorable microclimatic conditions;
 maintenance high level performance and prevention of employee fatigue.
5.11. In order to organize the procedure for providing employees with personal protective equipment, washing and neutralizing agents, the Institution establishes:
 the procedure for identifying the need to provide employees with personal protective equipment, washing and neutralizing agents;
 the procedure for providing employees with personal protective equipment, washing and neutralizing agents, including the organization of accounting, storage, decontamination, dry cleaning, washing and repair of personal protective equipment;
 a list of professions (positions) of employees and their personal protective equipment, washing and neutralizing agents.
5.12. In order to identify the need to provide employees with personal protective equipment, flushing and neutralizing agents, the employer determines the name, details and content of the standard standards for the issuance of personal protective equipment, flushing and neutralizing agents to employees, the use of which is mandatory.
5.13. The issuance of personal protective equipment, flushing and neutralizing agents to employees in excess of the established standards for their issuance or in cases not defined by the standard standards for their issuance, is carried out depending on the results of the procedures for assessing working conditions and levels of occupational risks.
5.14. In order to organize procedures for providing workers with milk, other equivalent food products or therapeutic and prophylactic nutrition, the Institution approves a list of professions (positions) of employees, work in which gives the right to receive free milk, other equivalent food products or therapeutic and prophylactic nutrition, the procedure for the provision of such products.
5.15. In order to organize the conduct of contract work or the supply of safe products, the Institution establishes (determines) the procedure for ensuring the safe performance of contract work or the supply of safe products, the responsibility of the contractor and the procedure for monitoring by the employer over the implementation of agreed actions to organize the safe performance of contract work or the supply of safe products. ...
5.16. When establishing a procedure for ensuring the safe performance of contract work or the supply of safe products, the following set of opportunities for contractors or suppliers to comply with employer requirements, including labor protection requirements, is used:
 provision of safe services and provision of safe products of adequate quality;
 effective communication and coordination with the levels of management of the employer before starting work;
 informing the employees of the contractor or supplier about the working conditions of the employer, the existing dangers;
 training on labor protection of contractor's or supplier's employees, taking into account the specifics of the employer's activities;
 control over the fulfillment by the contractor or supplier of the employer's requirements in the field of labor protection.

6. PLANNING OF ACTIVITIES FOR THE IMPLEMENTATION OF THE PROCEDURES

6.1. In order to plan measures for the implementation of procedures in the Institution, the procedure for the preparation, revision and updating of an action plan for the implementation of procedures (hereinafter referred to as the Plan) is established.
6.2. The Plan reflects:
 the results of an analysis of the state of labor conditions and labor protection at the employer carried out by the labor protection committee (commission) (if any) or by the employer;
 a general list of activities carried out during the implementation of procedures;
 the expected result for each activity carried out during the implementation of the procedures;
 terms of implementation for each event carried out during the implementation of procedures;
 responsible persons for the implementation of activities carried out during the implementation of procedures at each level of management;
 a source of funding for activities carried out during the implementation of the procedures.

7. CONTROL OF OSMS FUNCTIONING AND MONITORING OF THE IMPLEMENTATION OF PROCEDURES

7.1. Control over the functioning of the OSH management system in the Institution is carried out in accordance with the procedure below.
7.2. Constant control over the functioning of the labor protection system is one of the means to prevent industrial injuries, occupational diseases, poisoning, and is carried out by promptly identifying deviations from the requirements of the rules and regulations of labor protection with the adoption of the necessary measures to eliminate them. The objects of control are:
 monitoring the state of the workplace, the equipment, tools, raw materials, materials used, the performance of work by the employee within the framework of the ongoing technological processes, identifying professional risks, as well as the implementation of other labor protection measures carried out constantly, monitoring the indicators of the implementation of procedures;
 control of the implementation of processes that have a periodic nature of implementation: assessment of working conditions of workers, training in labor protection, medical examinations, psychiatric examinations, chemical and toxicological studies;
 accounting and analysis of accidents, accidents, occupational diseases, as well as changes in labor protection requirements, labor protection agreements to be implemented, changes or introduction of new technological processes, equipment, tools, raw materials and materials;
 control over the efficiency of the OSMS functioning as a whole.
7.3. Conducting regular checks involves:
 operational control;
 targeted checks;
 unscheduled inspections;
 comprehensive checks.
7.4. To increase the efficiency of control over the functioning of the OSMS and monitoring the indicators of the implementation of procedures at each level of management, a three-stage form of control over the functioning of the OSMS is introduced:
 I level of control - the head of the structural unit of the Institution;
 II level of control - chief physician, deputy chief physicians, labor protection specialist;
 III level of control - labor protection commission.
7.5. Operational control carried out daily by the head of the structural unit.
7.6. Targeted inspections are carried out by the chief physician (his deputies) and a labor protection specialist with the participation of a labor protection representative from the labor collective. The checks are carried out in accordance with the approved schedule. The results of inspections are drawn up in the form of a prescription act indicating the identified violations and inconsistencies, the deadlines for elimination and the appointment of persons responsible for eliminating the identified violations.
7.7. Unscheduled inspections are carried out outside the target and due diligence schedule. results unscheduled inspections are drawn up, if necessary, by appropriate acts.
7.8. In the event of gross violations, the labor protection specialist prepares a draft order on the results of the inspection, determining the degree of guilt of the violators and developing measures for the identified comments, identifying those responsible for the implementation of the identified shortcomings in a timely manner.
7.9. In cases when, in the course of monitoring the functioning of an OSMS and monitoring the implementation of procedures, the need to prevent the reasons for non-fulfillment of any requirements, and, as a consequence, a possible recurrence of accidents, accidents, occupational diseases, is identified, corrective actions are immediately taken.
7.10. The management and personnel of the Institution are obliged to pay attention to the conduct of work in accordance with the requirements of the rules and regulations of labor protection.
7.11. All types of inspections and examinations should be carried out with the simultaneous provision of practical assistance in organizing work to create a safe working environment.

8. PLANNING OF FUNCTIONAL IMPROVEMENTS

8.1. In order to organize planning to improve the functioning of an OSMS in the Institution, the dependence of improving the functioning of an OSMS on the results of monitoring the functioning of an OSMS and monitoring the implementation of procedures is established, as well as the obligation to take into account the results of investigations of accidents, accidents, occupational diseases, the results of control and supervisory activities of bodies state power, proposals of employees and (or) their authorized representative bodies.
8.2. When planning to improve the functioning of an OSMS, an analysis of the effectiveness of an OSMS is carried out, which includes an assessment of the following indicators:
 degree of achievement of the employer's goals in the field of labor protection;
 the ability of the OSHMS to ensure the fulfillment of the employer's obligations as reflected in the Occupational Safety Policy;
 the effectiveness of actions planned by the employer at all levels of management based on the results of the previous analysis of the effectiveness of the OSMS functioning;
 the need to change the OSHMS, including adjusting the goals in the field of labor protection, redistribution of duties of the employer's officials in the field of labor protection, redistribution of the employer's resources;
 the need to ensure timely training of those workers who will be affected by decisions to change the OSHMS;
 the need to change the criteria for assessing the effectiveness of the OSMS functioning.

9. RESPONSE TO ACCIDENTS, ACCIDENTS AND OCCUPATIONAL DISEASES

9.1. Investigations into the occurrence and root causes of accidents and occupational diseases in the workplace are aimed at identifying any deficiencies in the OSH management system and should be documented.
9.2. The procedure for investigating industrial accidents is established by Art. 227-231 of the Labor Code of the Russian Federation and the Regulation on the specifics of investigating industrial accidents in certain industries and organizations, approved by the Resolution of the Ministry of Labor of the Russian Federation of October 24, 2002, No. 73.
9.3. The results of the investigations are brought to the attention of the OSH Commission for the formulation of appropriate recommendations.
9.4. The results of investigations and recommendations of the OSH Commission are communicated to the appropriate persons in order to take corrective actions, included in the analysis of the effectiveness of the OSH management system by management and taken into account in the activities for continuous improvement.
9.5. Analysis of accidents is carried out using:

 receiving and considering external and internal messages related to labor protection, their documenting, as well as preparation and issuance of answers to them;
 ensuring the internal transfer and exchange of information on labor protection between the relevant levels and functional structures of the Institution;
 receiving, guaranteed consideration and preparation of responses to inquiries, ideas and proposals of employees, as well as their representatives on labor protection.

11. PREVENTIVE MEASURES

11.1. Preventive and control measures.
11.1.1. It is advisable to carry out preventive and control measures in next order priority:
 elimination of danger and risks;
 limiting hazards and risks at their source by using technical means of collective protection or organizational measures;
 minimization of hazards and risks by using safe production systems, as well as measures of administrative limitation of the total time of contact with harmful and hazardous production factors;
 if it is impossible to limit the dangers and risks by means of collective protection or organizational measures, the head physician of the Institution provides appropriate personal protective equipment, including overalls, free of charge, and takes measures to ensure their use and mandatory maintenance.
11.1.2. Procedures or measures are established to prevent and minimize hazards and risks, ensuring:
 hazard identification and risk assessment in the workplace;
 regular review of the procedure for preventing and minimizing hazards and risks and, if necessary, modification of these procedures;
 compliance federal laws and other regulatory legal acts, popularization of best practices;
 accounting current state knowledge and best practices, including information or reports state inspection labor, labor protection services, if necessary, and other services.
11.1.3. To assess the actual values ​​of hazardous and harmful production factors at workplaces and determine the degree of their danger and harmfulness, at least once every 5 years, a special assessment of working conditions is carried out. 11.1.4. To develop measures to prevent emergency situations, prepare for them and eliminate their consequences, the possible nature of emergency situations is determined, and the prevention or reduction of risks associated with them is envisaged. These activities are corrected in a timely manner, if necessary, changes are made. Activities are developed in accordance with the type, nature and scale of the organization's activities. They must:
 ensure, in the event of an emergency, that the necessary information, internal communication systems and emergency response coordination ensure the protection of all people in the work area;
 provide information to the relevant competent authorities in the event of an emergency, territorial structures and emergency services, to ensure reliable communication with them;
 provide for the provision of first aid, firefighting measures and the evacuation of all people in the work area;
 Provide relevant information to all employees of the Institution at all levels and the possibility of their training in preventing emergency situations, ensuring preparedness for them and eliminating their consequences, including conducting regular training in conditions close to real emergency situations.
Measures to prevent emergency situations, ensure preparedness for them and eliminate their consequences should be coordinated with external emergency services and other competent authorities.
11.1.5. Ensuring the supply of safe products.
11.1.5.1. The supplier's supply of the required safe products is ensured by selection based on his ability to meet customer requirements.
11.1.5.2. The selection process for qualified suppliers should include:
 assessment of the supplier's ability to supply certified equipment and materials, measuring equipment, protective equipment, personal protective equipment;
 assessment of the completeness and reliability of the information provided on the hazardous properties of products and measures for safe handling;
 determination, assessment and inclusion in the terms of the procurement contract of the customer's requirements for the supply of certified equipment and materials, measuring equipment, protective equipment, work clothes and footwear;
 determination and assessment of the requirements of laws and other regulatory legal acts, as well as the organization's requirements for labor protection prior to purchasing products;
 incoming safety control of supplied products;
 meeting the requirements before using the purchased products;
 requirements for the timely introduction of changes to the documentation.
