Class ranks in municipal service: appropriation and preservation. On the procedure for assigning and retaining class ranks of municipal employees in the Kurgan region.

Article 2. Assignment of class ranks

1. Class ranks are assigned to municipal employees personally in accordance with the sequence from 3 to 1 class, in accordance with the position of the municipal service within the group of municipal service positions, taking into account the duration of the replacement of the municipal service position or the length of stay in the previous class rank.

2. The first class ranks are:

1) for the highest group of positions in the municipal service - the actual municipal councilor of the Moscow region of the 3rd class;

2) for the main group of posts of the municipal service - the municipal councilor of the Moscow region of the 3rd class;

3) for the leading group of positions in the municipal service - the councilor of the municipal service of the Moscow region of the 3rd class;

4) for senior group positions of the municipal service - senior assistant of the municipal service of the Moscow region, 3rd class;

5) for junior group positions of the municipal service - assistant of the municipal service of the Moscow region of the 3rd class.

3. A municipal employee who does not have a class rank or is appointed to a higher position in the municipal service of another group of positions in the municipal service, according to the results of the qualifying exam, is assigned the first class rank.

4. A municipal employee who replaces for a certain term of office the position of the category "leaders" of the highest group of positions, the position of the category "assistants (advisers)", the first class rank is assigned after the successful completion of the test, and if the test was not established, then no earlier than three months after the appointment of a municipal employee to a municipal service position without a qualifying examination.

5. The next class rank is awarded to a municipal employee after the expiration of the established period of stay in the previous class rank, and on the condition that he replaces a municipal service position for which a class rank is provided, equal to or higher than the class rank assigned to a municipal employee.

6. As a measure of encouragement for special distinctions in the municipal service, the next class rank to a municipal employee may be awarded:

1) before the expiration of the period of stay in the relevant class rank, established by Article 5 of this Law, but not earlier than six months of being in the substituted position of the municipal service - not higher than the class rank corresponding to this position of the municipal service;

2) after the expiration of the period established for staying in the corresponding class rank - one step higher than the class rank corresponding to the substituted municipal service position within the group of municipal service positions to which the substituted position belongs.

Article 3. Class ranks conferred on persons holding municipal offices

1. Persons holding municipal posts, taking into account the length of their stay in municipal posts in the Moscow Region without passing a qualifying exam, shall be assigned the following class ranks:

valid municipal councilor of the Moscow region of the 3rd class - when filling a municipal position from one to two years;

valid municipal councilor of the Moscow region of the 2nd class - when filling a municipal position from two years to three years;

valid municipal councilor of the Moscow region of the 1st class - in case of filling a municipal position for more than three years.

2. Class rank to persons holding municipal offices is assigned by the decision of the Council of Deputies municipality Moscow region within one month after the expiry of the corresponding term for filling a municipal position.

Article 4. Retention of class ranks

1. The assigned class rank is retained by the municipal employee when he is transferred to another position in the municipal service, when he is dismissed from the municipal service, as well as when he enters the municipal service again.

If elected to municipal office a person holding a class rank, the previously assigned class rank is retained for the period of filling a municipal position until the appropriate class rank is awarded in accordance with Article 3 of this Law.

2. If the class rank assigned earlier is lower than the class rank corresponding to the position to which the municipal employee has been appointed, the class rank shall be retained until the assignment of the class rank corresponding to the new position being replaced.

Article 5. Terms of stay in class ranks

1. For the assignment of the next class rank, the following terms of stay in class ranks are established:

for a valid municipal councilor of the Moscow region of the 3rd and 2nd class - at least two years of municipal service in each class;

for a municipal councilor of the Moscow region of the 3rd and 2nd class - at least two years of municipal service in each class;

for the councilor of the municipal service of the Moscow region of the 3rd and 2nd class - at least two years of municipal service in each class;

for the senior assistant of the municipal service of the Moscow region of the 3rd and 2nd class - at least one year of municipal service in each class;

for the assistant of the municipal service of the Moscow region of the 3rd and 2nd class - at least one year of municipal service in each class.

The terms of stay in class ranks of the real municipal councilor of the Moscow region of the 1st class, the municipal councilor of the Moscow region of the 1st class, the councilor of the municipal service of the Moscow region of the 1st class, the senior assistant of the municipal service of the Moscow region of the 1st class, the assistant of the municipal service of the Moscow region 1st class are not installed.

2. The period of stay in a class rank is calculated from the date of conferring the corresponding class rank. The day of assignment of a class rank is the day when the municipal employee passes the qualification exam.

The period of stay in a class rank does not include:

the period of leave without pay, the duration of which exceeds seven days, with the exception of the period of maternity leave;

the time when the citizen did not fill the position of the municipal service of the Moscow region and the municipal position.

In the cases established by this Law of conferring a class rank without holding a qualifying examination, the day of conferring a class rank shall be deemed the day following the expiration of the period established for staying in the corresponding class rank.

Article 6. Duration of the qualification examination

1. The qualification examination is held within one month from the date:

successful completion of the test;

the expiration of three months after the appointment to the post of municipal service, if the test was not established.

The qualification examination is not administered to a municipal employee with an unreleased disciplinary sanction.

2. The date, time and place of the qualification examination shall be established by the chairman of the attestation commission and brought to the attention of the examined municipal employee no later than one month before the qualification examination.

3. The date of the qualification examination is postponed if the examined municipal employee fails to appear at the meeting of the certification commission for a good reason at the next meeting of the certification commission, but no more than one month after the change in the circumstances that caused the failure to appear.

Article 7. Documents Submitted to the Attestation Commission

1. Not later than two weeks before the qualification examination of the municipal employee in the attestation commission personnel service a submission is sent to a municipal employee.

2. The submission must contain the following information:

surname, name, patronymic of a municipal employee;

the position of the municipal service to be replaced on the date of the qualification examination and the date of appointment to this position;

information about the length of service in municipal service positions;

information about additional professional training, professional development or retraining of a municipal employee;

a list of the main issues in the solution of which the municipal employee took part;

assessment of the level of knowledge, skills and abilities ( professional level) a municipal employee and the possibility of assigning him the appropriate class rank;

on incentives applied to a municipal employee from the date of the last class rank assignment to him;

information about the previously assigned class rank.

The submission is signed by the immediate supervisor of the municipal employee and the head of the personnel service.

The municipal employee must be familiar with the submission at least 10 working days prior to the day of the qualification examination.

3. The form of submission to the municipal employee and the examination sheet shall be established by the Department of State and Municipal Service of the Moscow Region.

The qualifying examination for the conferment of a class rank is carried out according to exam tickets, approved by the head of the municipal formation of the Moscow region.

Article 9. Conduct of the qualification examination

1. The qualification exam is conducted by an attestation commission formed in accordance with the legislation by the head of the municipal formation of the Moscow region and acting in accordance with the Regulations on the attestation of municipal employees, approved by the municipal legal act.

2. The qualification examination in the absence of the examined municipal employee is not allowed.

3. A municipal employee who is a member of the attestation commission passes the qualification exam on a general basis, and in this regard, his powers as a member of the attestation commission are suspended for the duration of the qualification exam.

4. Based on the results of the qualification examination, one of the following decisions can be made in relation to a municipal employee:

1) the qualifying examination for conferring the corresponding class rank has been passed;

2) the qualification examination for conferring the corresponding class rank has not been passed;

3) the qualification examination has been postponed due to the absence of the municipal employee for the qualification examination for a good reason.

5. Decisions of the certification commission are made in the absence of the examined municipal employee by an open vote by a simple majority of votes of the members of the certification commission present at the meeting. With an equal number of votes "for" and "against", the municipal employee is deemed to have passed the qualification exam.

6. The results of the qualification exam are drawn up in a protocol, which is signed by all members of the attestation commission who were present, and are communicated orally to the examined municipal employee immediately after the end of voting for this municipal employee.

The form of the protocol is established by the Office of the State and Municipal Service of the Moscow Region.

7. The result of the qualification exam is entered on the examination sheet. The examination sheet is signed by the chairman, deputy chairman, secretary and members of the attestation commission who attended the qualification exam.

The municipal employee must be familiarized with the examination sheet against receipt within five working days after passing the qualifying exam.

The examination sheet is kept in the personal file of the municipal employee.

Article 10. Granting a class rank

1. The order of the head of the municipal formation of the Moscow Region on conferring a class rank on a municipal employee shall be adopted no later than 10 working days from the date of the qualification exam, and in cases of assigning a class rank without holding a qualifying exam - no later than 10 working days after the expiration of the established period of stay in previous class rank.

2. A copy of the decision of the Council of Deputies of the Municipal Formation of the Moscow Region on the assignment of a class rank to a person holding a municipal position, or a copy of the order of the head of the Municipal Formation of the Moscow Region on the assignment of a class rank to a municipal employee is kept in the personal file.

3. The record of the assignment of a class rank is made in work book.

Municipal service positions are divided into the following groups:

1) the highest positions of the municipal service;

2) the main positions of the municipal service;

3) leading positions of the municipal service;

4) senior positions in the municipal service;

5) junior positions of the municipal service.

Municipal employees are awarded the following class ranks:

the secretary of the municipal service of the 3rd, 2nd, 1st class - to the municipal employee replacing the posts of the municipal service of the younger group;

the referent of the municipal service of the 3rd, 2nd, 1st class - to the municipal employee replacing the positions of the municipal service of the senior group;

councilor of the municipal service of the 3rd, 2nd, 1st class - to the municipal employee who replaces the positions of the municipal service of the leading group;

municipal councilor of the 3rd, 2nd, 1st class - a municipal employee who replaces the posts of the municipal service of the main group;

a valid municipal councilor of the 3rd, 2nd, 1st class - to a municipal employee who replaces the posts of the municipal service of the highest group.

Level requirements apply vocational education, civil service experience, work experience in the specialty, professional knowledge and skills. 1. Class ranks of municipal employees (hereinafter - class ranks) indicate the conformity of the level vocational training municipal employees qualification requirements for filling municipal service positions.

2. The following class ranks are envisaged:

for municipal employees holding senior positions in the municipal service - a valid municipal councilor of the 1st, 2nd or 3rd class;

for municipal employees filling the main positions of the municipal service - a municipal councilor of the 1st, 2nd or 3rd class;

for municipal employees holding leading positions in the municipal service - a municipal service counselor of the 1st, 2nd or 3rd class;

for municipal employees holding senior positions in the municipal service - the assistant of the municipal service of the 1st, 2nd or 3rd class;

for municipal employees filling junior positions in the municipal service - the secretary of the municipal service of the 1st, 2nd or 3rd class.

Article 4.2. The procedure for the assignment of class ranks and their preservation when transferring municipal employees to other positions in the municipal service and upon dismissal from the municipal service

1. Class ranks are assigned to municipal employees personally in accordance with the position of the municipal service being replaced within the group of positions in the municipal service, as well as taking into account the professional level and duration of municipal service in the replaced position of the municipal service.

2. The class rank can be the first or the next.

3. The first class ranks, depending on the group of posts of the municipal service, to which the post of municipal service, replaced by a municipal employee, belongs, are the corresponding class ranks of the 3rd class.

4. The first class rank is assigned to a municipal employee who does not have a class rank after the successful completion of the test, and if the test was not established, then no earlier than three months after the appointment of the municipal employee to the position of municipal service.

5. The next class rank is awarded to a municipal employee after the expiration of the period established for passing municipal service in the previous class rank, and on the condition that he replaces the position of the municipal service for which a class rank is provided higher than the class rank assigned to a municipal employee.

6. The term for municipal service in the class ranks of the secretary of the municipal service of the 2nd and 3rd classes, the assistant of the municipal service of the 2nd and 3rd classes, the councilor of the municipal service of the 2nd and 3rd classes, the municipal councilor of the 2nd 1st and 3rd grade, valid municipal councilor 2nd and 3rd grade is at least three years.

The term for passing municipal service in the class ranks of the secretary of the municipal service of the 1st class, the assistant of the municipal service of the 1st class, the councilor of the municipal service of the 1st class, the municipal councilor of the 1st class and the actual municipal councilor of the 1st class is not established.

7. The duration of the municipal service in the assigned class rank is calculated from the date of its assignment.

8. As a measure of encouragement for special distinctions in the municipal service, a class rank may be awarded to a municipal employee:

1) before the expiration of the period established by paragraph one of part 6 of this article for the passage of municipal service in the corresponding class rank, but not earlier than six months of being in the substituted municipal service position, - not higher than the class rank corresponding to this municipal service position within the group posts of the municipal service, to which the substituted post of the municipal service belongs;

2) after the expiration of the period established by the first paragraph of part 6 of this article - one step higher than the class rank corresponding to the substituted municipal service position within the group of municipal service positions to which the substituted position belongs.

9. When appointing a municipal employee to a higher position of municipal service within one group of positions, he may be awarded the next class rank if the period established by paragraph one of part 6 of this article for passing municipal service in the previous class rank has expired, and provided that for the position of the municipal service, a class rank is provided that is higher than the class rank that a municipal employee has.

When appointing a municipal employee to a municipal service position that belongs to a higher group of municipal service positions than the one replaced by him earlier, the specified municipal employee may be assigned a class rank, which, in accordance with Part 3 of this article, is the first for this group of municipal service positions, if this class rank is higher than the class rank that the municipal employee has. In this case, the class rank is assigned without observing the sequence and without taking into account the duration of the municipal service in the previous class rank.

10. Municipal employees who replace without limitation of the term of office the main, leading, senior, junior positions of the municipal service, class ranks are assigned based on the results of the qualification exam, which is conducted by the certification commission of the local government, municipal body.

Municipal employees who fill the highest positions of the municipal service without limitation of their term of office are awarded class ranks based on the results of the qualification exam, if the decision to pass the qualification exam by them is made by the representative of the employer (employer).

The qualification exam is carried out in the manner established for passing the qualification exam by state civil servants of the Russian Federation by Decree of the President of the Russian Federation of February 1, 2005 N 111 "On the procedure for passing the qualification exam by state civil servants of the Russian Federation and assessing their knowledge, skills and abilities (professional level) ".

11. The class rank is assigned to the municipal employee by the municipal legal act of the representative of the employer (employer).

12. The day of the assignment of a class rank to a municipal employee is the day of passing the qualification exam.

In the case of conferring a class rank on a municipal employee without passing a qualifying exam, the day of conferring a class rank shall be deemed to be the day when a representative of the employer (employer) adopts a municipal legal act on conferring a class rank on a municipal employee.

13. From the date of conferring a class rank on a municipal employee, a monthly supplement to the official salary for a class rank is established in accordance with the assigned class rank.

14. The record of the assignment of a class rank is entered in the work book and the personal file of the municipal employee.

15. When entering the municipal service of a citizen of the Russian Federation who has the class rank of public service, diplomatic rank, military or special title, the first class rank of the municipal service is assigned to him in accordance with the substituted position of the municipal service within the group of positions of the municipal service.

Upon admission to the municipal service of a person who has the class rank of municipal service, assigned during the passage of municipal service on the territory of another constituent entity of the Russian Federation, the first class rank of the municipal service is assigned to him in accordance with the position of the municipal service being replaced within the group of positions of the municipal service.

16. The next class rank is not awarded to municipal employees with disciplinary sanctions, municipal employees against whom a criminal case has been initiated, as well as to municipal employees temporarily suspended from their duties in connection with the resolution of the issue of their disciplinary liability.

17. The assigned class rank is retained by the municipal employee upon dismissal from the municipal service (including in connection with retirement), upon transfer to other positions in the municipal service, and also upon entering the municipal service again.

Federal law of July 27, 2004 N 79-FZ "On the state civil service of the Russian Federation" and Article 13 of the Federal Law of May 27, 2003 N 58-FZ "On the system of civil service of the Russian Federation" determine the procedure for assigning and retaining class ranks of the state civil services of the Russian Federation (hereinafter - class ranks) to federal state civil servants (hereinafter - federal civil servants).

2. Article 11 of the Federal Law of July 27, 2004 N 79-FZ "On the state civil service of the Russian Federation" establishes the following class ranks corresponding to the groups of positions in the federal state civil service (hereinafter referred to as civil service positions):

3. The seniority of class ranks is determined by the sequence of their listing in clause 2 of these Regulations.

4. Class ranks are assigned to federal civil servants personally, in compliance with the sequence, in accordance with the civil service position being replaced within the group of civil service positions, as well as taking into account the professional level, the duration of the state civil service of the Russian Federation (hereinafter - the civil service) in the previous class rank and in the civil service position being replaced.

5. The class rank can be the first or the next.

The first class rank of the civil service is assigned to a federal civil servant who does not have a class rank in the civil service and who replaces the civil service position for which the class ranks of the civil service are assigned. At the same time, in accordance with clause 22 of these Regulations, the military or special rank, class rank of justice, class rank of a prosecutor's employee, assigned to a federal civil servant at the previous place of state service of the Russian Federation, are taken into account.

6. The first class ranks (depending on the group of civil service positions to which the civil service position replaced by a federal civil servant belongs) are:

a) for the junior group of civil service positions - the secretary of the state civil service of the Russian Federation, grade 3;

b) for the senior group of civil service positions - an assistant of the state civil service of the Russian Federation, grade 3;

c) for the leading group of positions in the civil service - an advisor to the state civil service of the Russian Federation, grade 3;

d) for the main group of civil service positions - the state adviser of the Russian Federation of the 3rd class;

e) for the highest group of civil service positions - a full state adviser of the Russian Federation of the 3rd class.

7. The first class rank is awarded to a federal civil servant after the successful completion of the test, and if the test was not established, then no earlier than three months after the appointment of a federal civil servant to the civil service position.

8. The next class rank is awarded to a federal civil servant upon the expiration of the period established for the civil service in the previous class rank, and on the condition that he replaces a civil service position for which a class rank is provided equal to or higher than the class rank assigned federal civil servant.

9. For the passage of the civil service, the following terms are established:

a) in the class ranks of the secretary of the state civil service of the Russian Federation of 3 and 2 classes, the assistant of the state civil service of the Russian Federation of 3 and 2 classes - at least one year;

b) in the class ranks of the civil service adviser of the Russian Federation of 3 and 2 classes, the state adviser of the Russian Federation of 3 and 2 classes - at least two years.

10. For civil service in the class ranks of a valid state adviser of the Russian Federation of 3 and 2 classes, as a rule, a period of at least one year is established.

11. For civil service in the class ranks of the secretary of the state civil service of the Russian Federation of the 1st class, the assistant of the state civil service of the Russian Federation of the 1st class, the advisor of the state civil service of the Russian Federation of the 1st class and the state adviser of the Russian Federation of the 1st class, no periods are set.

12. The term of civil service in the assigned class rank is calculated from the date of conferring the class rank.

13. When appointing a federal civil servant to a higher position in the civil service, he may be awarded the next class rank if the period established by paragraph 9 or this Regulation for passing the civil service in the previous class rank has expired, and provided that for this position of the civil service there is a class rank equal to or higher than the class rank assigned to a federal civil servant.

When appointing a federal civil servant to a civil service position that belongs to a higher group of civil service positions than the one replaced by him earlier, the specified employee may be assigned a class rank, which, in accordance with paragraph 6 of this Regulation, is the first for this group of civil service positions, if this class rank is higher than the class rank held by a federal civil servant. In this case, the class rank is awarded without observing the sequence and without taking into account the duration of the civil service in the previous class rank.

A class rank is assigned to a federal civil servant in accordance with this paragraph after the successful completion of the test, and if the test was not established, then not earlier than three months after his appointment to the civil service position.

14. Federal civil servants holding civil service positions for a specified term of office (with the exception of federal civil servants filling civil service positions of the "managers" category, belonging to the highest group of civil service positions, as well as federal civil servants filling civil service positions of the "category" assistants (advisers) ", the appointment and release from which are carried out by the President of the Russian Federation, and federal civil servants filling civil service positions belonging to the main group of civil service positions, the appointment and release from which are carried out by the Government of the Russian Federation), class ranks are awarded based on the results of a qualifying exam.

15. Class ranks of the actual state adviser of the Russian Federation of 1, 2 and 3 classes are awarded by the federal civil servant by the President of the Russian Federation.

a) in federal bodies executive power whose activities are managed by the President of the Russian Federation - on the proposal of the heads of these bodies, in other federal executive bodies - on the proposal of the Government of the Russian Federation;

b) in other federal state bodies or their offices - on the proposal of the heads of these bodies.

17. Class ranks of the State Councilor of the Russian Federation of 1, 2 and 3 classes are assigned to federal civil servants:

a) in federal executive bodies - by the Government of the Russian Federation;

b) in other federal state bodies - by the heads of these bodies.

18. Class ranks of the advisor of the state civil service of the Russian Federation of 1, 2 and 3 classes, the assistant of the state civil service of the Russian Federation of 1, 2 and 3 classes, the secretary of the state civil service of the Russian Federation of 1, 2 and 3 classes are assigned by the federal civil servant by the representative of the employer represented by head of the federal government body or a representative of this head, exercising the powers of a representative of the employer on behalf of the Russian Federation.

19. Class ranks are conferred by federal civil servants, respectively, by an act of the President of the Russian Federation, the Government of the Russian Federation, the head of a federal state body or a representative of the said head.

Section 4. Class ranks of municipal employees

1. Class ranks of the municipal service are assigned to a municipal employee based on the results of the qualification exam and confirm the compliance of the level of professional training of a municipal employee with the qualification requirements for persons filling the positions of the municipal service of the corresponding group.

2. Municipal employees can be awarded the following qualification categories:

1) the secretary of the municipal service of the 3rd, 2nd, 1st class - to employees who fill the junior positions of the municipal service;

2) an assistant of the municipal service of the 3rd, 2nd, 1st class - to an employee who replaces senior positions in the municipal service;

3) a municipal councilor of the 3rd, 2nd, 1st class - to an employee who replaces the main positions of the municipal service.

The seniority of class ranks is determined by the order in which they are listed.

3. A municipal employee may be awarded a class rank not higher than the class rank established for the position he is replacing.

4. The assigned class rank of municipal employees shall be retained by the municipal employee upon transfer to other positions of the municipal service, upon dismissal from the municipal service, as well as upon entering the municipal service again.

4.1. If the class rank assigned earlier is lower than the class rank corresponding to the position to which the municipal employee has been appointed, the class rank shall be retained until the assignment of the class rank corresponding to the new position being replaced.

5. Qualification ranks assigned to persons filling municipal service positions prior to the entry into force of this Procedure shall be considered the corresponding class ranks established by this Procedure.

6. Disputes related to the assignment of class ranks and their preservation are considered in the manner prescribed by the legislation of the Russian Federation and the legislation of the Republic of Adygea.

The procedure for assigning a class rank to a municipal employee

7. Class ranks for municipal employees are assigned by the head of the body local government.

8. The record of assigning a class rank to a municipal employee is entered into the work book. The documents confirming the assignment of the class rank are attached to the personal file of the municipal employee.

9. A person who is first recruited into municipal service, who does not have the rank of municipal service and replaces the position of the municipal service for which the assignment of class ranks is carried out, is assigned the lowest class rank of the 3rd class, established by the position he is replacing.

10. The first class rank is assigned to a municipal employee after the successful completion of the test and passing the qualifying exam, and if the test was not established, then the next day after the end of the three-month period after the appointment of the municipal employee to the position of municipal service.

11. The next class rank is assigned to a municipal employee on the next day after the expiration of the period established for the passage of municipal service in the previous class rank.

11.1. For the passage of municipal service in the class ranks of municipal employees, the following terms are established:

1) 1 year - in the class ranks of municipal employees of the secretary of the municipal service of the 3rd, 2nd class and the assistant of the municipal service of the 3rd and 2nd class;

2) 2 years - in the class ranks of municipal employees of the municipal councilor of the 3rd and 2nd class.

11.2. For the passage of municipal service in the class ranks of municipal employees of the 1st class, established for the position being replaced, the term is not established.

12. The period of temporary incapacity for work of a municipal employee, other periods (except for annual paid leave) when he did not perform official duties, but after him in accordance with current legislation the municipal service position replaced by him was preserved, as well as the period of application of a disciplinary sanction to the municipal employee.

13. As a measure of encouragement, a municipal employee may be awarded a class rank in accordance with the legislation of the Republic of Adygea.

14. Municipal employees are given a monthly supplement to official salary for a class rank from the date of its assignment in the amounts established by local authorities in accordance with the laws and other normative legal acts of the Republic of Adygea.
