  • impose according to current legislation against citizens and legal entities, including manufacturers (executors, sellers), for violation of fire safety requirements, as well as for other offenses in the field of fire safety, including for evasion or untimely execution of orders and decisions of officials of the State Tax Inspectorate.

The organizational structure, powers, tasks, functions and the procedure for organizing and carrying out the activities of the GPN bodies are determined, approved in accordance with the established procedure. State fire supervision in forests is carried out by the authorized federal executive body, and at underground facilities and during the production, transportation, storage, use and disposal of explosive materials in organizations conducting blasting operations using explosive materials industrial use, - the federal executive body authorized in the field of industrial safety.

Federal State Fire Supervision Regulations

1. Federal state fire supervision, with the exception of federal state fire supervision, carried out in forests, at underground facilities, during mining operations, during the production, transportation, storage, use and disposal of industrial explosives, is carried out by officials of the state fire supervision bodies of the federal the fire service of the State Fire Service (hereinafter referred to as the state fire supervision bodies), which are state fire inspectors.

The bodies of state fire supervision carry out activities aimed at preventing, detecting and suppressing violations by organizations and citizens of the requirements established by the legislation of the Russian Federation on fire safety, by organizing and conducting, in the prescribed manner, inspections of the activities of organizations and citizens, the state of the protected objects used (operated) by them, as well as systematic monitoring of compliance with fire safety requirements, analysis and prediction of the state of execution specified requirements when organizations and citizens carry out their activities.

2. The bodies of state fire supervision are:

a) a structural unit of the central office of the Ministry of the Russian Federation for civil defense, emergencies and liquidation of consequences natural Disasters, whose sphere of competence includes the organization and implementation of federal state fire supervision;

b) structural divisions territorial bodies The Ministry of the Russian Federation for Civil Defense, Emergencies and Elimination of the Consequences of Natural Disasters - regional centers for civil defense, emergencies and elimination of the consequences of natural disasters, which are responsible for the organization and implementation of federal state fire supervision;

c) structural subdivisions of the territorial bodies of the Ministry of the Russian Federation for Civil Defense, Emergencies and Elimination of the Consequences of Natural Disasters - bodies specially authorized to solve civil defense tasks and tasks of prevention and elimination emergencies for the constituent entities of the Russian Federation, whose sphere of jurisdiction includes the organization and implementation of federal state fire supervision, and their territorial divisions (departments, inspections);

d) structural units of special and military units of the federal fire service, whose sphere of competence includes the organization and implementation of federal state fire supervision, created in order to organize the prevention and extinguishing of fires in closed administrative-territorial entities, especially important and sensitive organizations.

3. The activities of the state fire control bodies are carried out on the basis of the subordination of the subordinate bodies of the state fire control to the higher ones.

4. Bodies of state fire supervision are guided in their activities by the Constitution of the Russian Federation, federal constitutional laws, federal laws, acts of the President of the Russian Federation and the Government of the Russian Federation, international treaties of the Russian Federation, regulatory legal acts The Ministry of the Russian Federation for Civil Defense, Emergencies and Elimination of the Consequences of Natural Disasters, as well as these Regulations.

5. Bodies of state fire supervision, within their competence:

a) organize and conduct inspections of the activities of organizations and citizens, the state of the protected objects used (operated) by them;

b) carry out, in accordance with the legislation of the Russian Federation, an inquiry in cases of fires and in cases of violations of fire safety requirements;

c) conduct, in accordance with the established procedure, proceedings on cases of administrative offenses in the field of fire safety;

d) carry out official statistical records and maintain state statistical reports on fires and their consequences;

e) interact with federal executive bodies, including bodies state control(supervision), by the executive authorities of the constituent entities of the Russian Federation, local self-government bodies, public associations and organizations, on issues of fire safety;

f) consider appeals and complaints of organizations and citizens on issues of fire safety;

g) carry out reception and accounting of notifications on the beginning of the implementation by legal entities and individual entrepreneurs of certain types of work and services according to the list approved by the Government of the Russian Federation.

6. The body of state fire supervision may be involved by a court in the case for giving an opinion on a claim for compensation for harm caused to the life, health of people, harm caused to animals, plants, environment, property of individuals and legal entities, state or municipal property due to violations of fire safety requirements.

7. Bodies of state fire supervision have stamps and forms of the established sample with their name.

8. The following state fire control inspectors are entitled to exercise powers in the established area of ​​activity:

a) Chief State Inspector of the Russian Federation for Fire Supervision - Chief State Inspector of the Russian Federation for Fire Supervision, who enjoys the rights of the Deputy Minister of the Russian Federation for Civil Defense, Emergencies and Elimination of the Consequences of Natural Disasters;

b) Deputy Chief State Inspectors of the Russian Federation for Fire Supervision - Head of the structural unit of the central office of the Ministry of the Russian Federation for Civil Defense, Emergencies and Elimination of Consequences of Natural Disasters, whose sphere of competence includes the organization and implementation of federal state fire supervision, and his deputies ;

c) state fire control inspectors of the Russian Federation - employees of a structural subdivision of the central office of the Ministry of the Russian Federation for Civil Defense, Emergencies and Elimination of the Consequences of Natural Disasters, whose sphere of competence includes the organization and implementation of federal state fire control, employees structural units territorial bodies of the Ministry of the Russian Federation for Civil Defense, Emergencies and Elimination of the Consequences of Natural Disasters - regional centers for civil defense, emergencies and elimination of the consequences of natural disasters, whose sphere of competence includes the organization and implementation of federal state fire supervision;

d) chief state inspectors of the constituent entities of the Russian Federation for fire supervision and their deputies - respectively, heads of structural divisions of territorial bodies of the Ministry of the Russian Federation for Civil Defense, Emergencies and Elimination of the Consequences of Natural Disasters - bodies specially authorized to solve civil defense tasks and tasks to prevent and liquidation of emergency situations in the constituent entities of the Russian Federation, whose sphere of jurisdiction includes the organization and implementation of federal state fire supervision, and their deputies;

e) state fire control inspectors of the constituent entities of the Russian Federation - employees of the structural divisions of the territorial bodies of the Ministry of the Russian Federation for Civil Defense, Emergencies and Elimination of the Consequences of Natural Disasters - bodies specially authorized to solve civil defense tasks and tasks for the prevention and elimination of emergency situations by constituent entities The Russian Federation, whose sphere of competence includes the organization and implementation of federal state fire supervision;

f) chief state inspectors of special and military units of the federal fire service for fire supervision and their deputies - respectively, heads of departments (divisions) of state fire supervision of divisions of the federal fire service, created in order to organize the prevention and extinguishing of fires in closed administrative-territorial formations, especially important and regime organizations, and their deputies;

g) state inspectors of special and military units of the federal fire service for fire supervision - employees of departments (divisions) of state fire supervision of units of the federal fire service, created in order to organize the prevention and extinguishing of fires in closed administrative-territorial formations, especially important and regime organizations;

h) chief state inspectors of cities (districts) of constituent entities of the Russian Federation for fire supervision and their deputies - respectively heads of territorial divisions (offices, inspections) of structural divisions of territorial bodies of the Ministry of the Russian Federation for civil defense, emergency situations and elimination of the consequences of natural disasters - bodies, those specially authorized to solve civil defense tasks and tasks for the prevention and elimination of emergency situations in the constituent entities of the Russian Federation, whose sphere of jurisdiction includes the organization and implementation of federal state fire supervision, and their deputies;

i) state inspectors of cities (regions) of constituent entities of the Russian Federation for fire supervision - employees of territorial departments (offices, inspections) of structural divisions of territorial bodies of the Ministry of the Russian Federation for Civil Defense, Emergencies and Elimination of the Consequences of Natural Disasters - bodies specially authorized to solve civil defense and tasks for the prevention and elimination of emergencies in the constituent entities of the Russian Federation, the scope of which includes the organization and implementation of federal state fire supervision.

9. State inspectors of cities (regions) of constituent entities of the Russian Federation for fire supervision and state inspectors of special and military units of the federal fire service for fire supervision in the manner prescribed by the legislation of the Russian Federation have the right to:

a) conduct inspections of the activities of organizations and citizens, the state of the protected objects used (operated) by them in terms of compliance with fire safety requirements;

b) without hindrance, upon presentation of an official certificate and a duly certified copy of the order of the head (deputy head) of the state fire supervision authority on the appointment of an inspection, to visit the territory and objects of protection and conduct their examinations. Inspection can only be carried out by an official (officials), which is indicated in the order of the head (deputy head) of the state fire supervision body;

c) conduct research, testing, examination, investigation and other control measures;

d) involve experts and expert organizations in the control measures;

e) request and receive, on the basis of motivated written requests from organizations and citizens, information and documents required during the audit;

f) issue orders to organizations and citizens to eliminate the identified violations of fire safety requirements (except for products sold), to take measures to ensure fire safety at the objects of protection and to prevent the threat of fire;

g) to conduct an inquiry in cases of fires and in cases of violations of fire safety requirements;

h) draw up protocols on administrative offenses related to violations of fire safety requirements, consider cases of these administrative offenses and take measures to prevent such violations, including applying before entering into legal force decisions in a case of an administrative offense temporary ban on the activities of branches, representative offices, structural divisions legal entity, production sites, as well as the operation of units, objects, buildings or structures, the implementation of certain types of activities (work), the provision of services, if necessary to prevent an immediate threat to life or health of people in the event of a fire.

10. Chief state inspectors of cities (districts) of constituent entities of the Russian Federation for fire supervision and their deputies, as well as chief state inspectors of special and military units of the federal fire service for fire supervision and their deputies enjoy the rights specified in paragraph 9 of these Regulations, and also have right:

a) appoint inspections of the activities of organizations and citizens, the state of the protected objects used (operated) by them in terms of compliance with fire safety requirements, as well as appoint inspections and conduct inspections of the activities of territorial bodies federal bodies executive power and local government bodies to ensure fire safety;

b) issue orders to organizations and citizens to eliminate the identified violations of fire safety requirements in relation to the products sold;

c) summon to the bodies of state fire supervision officials of organizations and citizens on cases and materials about fires in the production of state fire supervision bodies, receive from these persons the necessary explanations, certificates, documents and their copies;

d) submit proposals to local governments on the establishment of a special fire regime on the relevant territory;

e) submit proposals to local authorities on the implementation of measures to ensure fire safety in accordance with the legislation of the Russian Federation;

f) cancel (change) illegal and (or) unreasonable decisions adopted by the subordinate state fire inspectors.

11. State fire control inspectors of the constituent entities of the Russian Federation enjoy the rights specified in clauses 9 and 10 of these Regulations, as well as in order to prepare a decision on approval or on the need for revision, have the right to consider special technical conditions for protected objects for which there are no requirements fire safety established by the regulatory legal acts of the Russian Federation and regulatory documents on fire safety, in terms of reflecting the specifics of ensuring fire safety of these facilities and the maintenance of a complex of necessary engineering, technical and organizational measures to ensure their fire safety.

12. The chief state fire control inspectors of the constituent entities of the Russian Federation and their deputies enjoy the rights specified in clauses 9-11 of these Regulations, and also have the right to:

a) carry out inspections of the activities of the executive authorities of the constituent entities of the Russian Federation to ensure fire safety;

b) submit proposals to the state authorities of the constituent entities of the Russian Federation on the establishment of a special fire-prevention regime in the territories of these constituent entities;

c) submit proposals to the state authorities of the constituent entities of the Russian Federation on the implementation of measures to ensure fire safety in accordance with the legislation of the Russian Federation;

d) make a decision on the approval or on the need for revision of special technical conditions for objects of protection, in respect of which there are no fire safety requirements established by the regulatory legal acts of the Russian Federation and regulatory documents on fire safety.

13. State inspectors of the Russian Federation for fire supervision enjoy the rights specified in clauses 9-12 of these Regulations, and also have the right to appoint inspections and conduct inspections of the activities of federal executive bodies and appoint inspections of the activities of executive bodies of the constituent entities of the Russian Federation to ensure fire security.

14. Deputy Chief State Inspectors of the Russian Federation for Fire Supervision shall enjoy the rights specified in clauses 9-13 of these Regulations.

15. The Chief State Inspector of the Russian Federation for Fire Supervision, along with the rights specified in clauses 9-13 of these Regulations, also has the right:

a) organize the development normative documents on fire safety, including documents regulating the procedure for the development, production and operation of fire-technical products;

c) agree on the provisions on departmental fire protection, containing the procedure for the implementation of departmental fire supervision at the objects of protection, subordinate to the Ministry of Internal Affairs of the Russian Federation, the Ministry of Defense of the Russian Federation, Federal Service security of the Russian Federation, the Federal Security Service of the Russian Federation, the Main Directorate of Special Programs of the President of the Russian Federation and the Service foreign intelligence Russian Federation.

16. Officials of the state fire control bodies shall be issued with appropriate service certificates and seals. Samples of service certificates and seals, as well as the procedure for their issuance, are approved by the Ministry of the Russian Federation for Civil Defense, Emergencies and Elimination of the Consequences of Natural Disasters.

17. Officials of the state fire control bodies are obliged to:

a) timely and fully implement the powers granted in accordance with the legislation of the Russian Federation to prevent, identify and suppress violations of fire safety requirements;

b) comply with the legislation of the Russian Federation, the rights and legitimate interests of organizations and citizens;

c) carry out an inspection on the basis of an order from the head (deputy head) of the state fire supervision body on its conduct in accordance with its purpose in the manner prescribed by the legislation of the Russian Federation;

d) carry out an inspection only during the performance of official duties upon presentation of service certificates, a copy of the order of the head (deputy head) of the state fire supervision body, and in cases stipulated by the legislation of the Russian Federation, a copy of the document on approval of the inspection;

e) not to interfere with the head, another official or an authorized representative of the organization, a citizen, his authorized representative to be present during the inspection and to provide explanations on issues related to the subject of the inspection;

f) in accordance with the established procedure, provide the head, another official or an authorized representative of the organization, a citizen, his authorized representative present during the inspection, information and documents related to the subject of the inspection;

g) in the prescribed manner to acquaint the head, another official, or authorized representative organization, citizen, his authorized representative with the results of the check;

h) take into account, when determining measures taken on the facts of revealed violations of fire safety requirements, the compliance of the indicated measures of the severity of these violations, their potential danger for life, health of people, the environment and property, as well as to prevent unreasonable restriction of rights and legitimate interests organizations and citizens;

i) to prove the validity of their actions when they are appealed by organizations and citizens;

j) comply with the terms of the inspection established by the legislation of the Russian Federation;

k) not demand from organizations and citizens documents and information, the submission of which is not provided for by the legislation of the Russian Federation;

l) before the start of the inspection, at the request of the head, another official or an authorized representative of the organization, a citizen, his authorized representative, familiarize them with the provisions administrative regulations, in accordance with which the check is carried out;

m) make a record of the inspection carried out in the inspection log.

18. Officials of bodies of state fire supervision over improper performance of their duties are liable in the manner prescribed by the legislation of the Russian Federation.

19. The financial and logistical support of the state fire control bodies is an expenditure obligation of the Russian Federation.

Recall that Sergei Shoigu fought for a long time for the transfer of the State Fire Inspection and the entire fire service in general from the Ministry of Internal Affairs, where they were listed, to the Ministry of Emergency Situations. Several years ago, the minister managed to achieve his goal with great difficulty, so the proposal to liquidate a large and influential structure, which came from the initiator of the recent reform, looked at least strange. “We are not talking about the disbandment of our service, but about the partial transfer of its functions to non-governmental organizations, which, of course, is a timely decision: we do not have enough people to pay attention to all organizations,” said Yuri Nenashev, head of the Department of Fire Control of the Russian Emergencies Ministry. According to him, Minister Shoigu proposed to divide all enterprises into more responsible in terms of fire safety and less responsible. 24. Bodies of state fire supervision keep lists of objects of protection, which are assigned risk categories (hereinafter - lists of objects of protection).

Inclusion in the lists of objects of protection is carried out on the basis of decisions of authorized officials on assigning objects of protection to the corresponding risk categories.

25. Lists of objects of protection contain the following information:

a) full name of the legal entity, last name, first name and patronymic (if any) individual entrepreneur who are the owners (rightholders) of the objects of protection, which have been assigned a risk category;

b) main state registration number;

c) individual taxpayer number;

d) location of the object of protection;

e) details of the decision to assign a risk category, an indication of the risk category, as well as information on the basis of which the decision was made to classify the protected object as a risk category.

26. The official website of the Ministry of the Russian Federation for Civil Defense, Emergencies and Elimination of the Consequences of Natural Disasters and its territorial bodies is posted and maintained up-to-date the following information on objects classified as extremely high, high and significant risk, contained in the lists of objects of protection:

Using checklists (lists control questions) is carried out during scheduled inspections of all protected objects used by legal entities and individual entrepreneurs.

The subject of a routine inspection is limited to the list of questions included in the checklists (checklists).

multi-apartment residential buildings, as well as objects of other functional purposes with a height of 28 meters or more, with the exception of objects classified as extremely high, high and significant risk;

objects intended for the residence or temporary stay of more than 200 people at the same time, with the exception of apartment buildings, as well as objects classified as extremely high, high and significant risk;

objects classified as fire hazard;

airports, with the exception of airports classified as significant risk, railway stations with an estimated capacity of up to 700 people, sea and river ports, bus stations;

diplomatic and consular institutions of the Russian Federation, as well as representations of the Russian Federation abroad;

objects intended for the residence or temporary stay of more than 50 people at the same time, with the exception of apartment buildings and objects classified as extremely high, high, significant and medium risk;

objects classified as moderate and low fire hazard;

outdoor installations, with the exception of outdoor installations classified as significant risk;

3. In accordance with the criteria for the likelihood of non-compliance by legal entities and individual entrepreneurs at the objects of protection they use, the mandatory requirements:

a) objects of protection to be classified in accordance with the criteria of the severity of potential negative consequences possible non-compliance at the protected object with the mandatory requirements for the category of high, significant, medium, moderate risk, are subject to classification as significant, medium, moderate and low risk, respectively, subject to one of the following conditions:

creation of a subdivision in accordance with the procedure established by the legislation of the Russian Federation fire department to protect the relevant facilities (with the exception of voluntary fire brigades);

the presence in the structure of a legal entity and an individual entrepreneur who use the object of protection, a unit dealing with issues fire prevention whose staff has a special fire-technical education and work experience in the system of state fire supervision or extinguishing fires for at least 5 years;

conducting a fire audit of the protected object ( independent evaluation fire risk) with the conclusion that the conditions for compliance of the specified object with fire safety requirements have been met;

absence of violations of fire safety requirements during the last scheduled inspection;

registration of a fire safety declaration for a protected object with no more than 2 floors, the total area of ​​which is no more than 1,500 square meters (except for preschool facilities with a simultaneous stay of more than 10 children, objects intended for the residence of children, the elderly and the disabled, with the simultaneous the stay of more than 10 people, apartment buildings, objects of primary general, basic general and secondary general education, objects of vocational education, hostels of educational organizations);

b) objects of protection to be classified in accordance with the criteria of the severity of potential negative consequences of possible non-compliance at the object of protection with mandatory requirements for the high category (except for objects intended for residence or temporary stay of people at night, where social and medical services are provided) and significant risk, subject to classification as significant and medium risk in the absence of fires at the facility for protection over the past 5 years;

c) objects of protection to be classified in accordance with the criteria of the severity of potential negative consequences of possible non-compliance at the object of protection with mandatory requirements to the category of significant, medium, moderate and low risk, are to be classified into the category of high, significant, medium and moderate risk, respectively, in the presence of one of the following conditions:

conducting a fire audit of a protected object (an independent assessment of fire risk) with the conclusion that the conditions for compliance of the specified object with fire safety requirements have not been met;

availability of information about a fire that has occurred at the object of protection over the past 5 years;

the presence of a court order that has entered into legal force on the imposition of a punishment in the form of an administrative suspension of the activities of a legal entity and an individual entrepreneur at the object of protection within the last 3 years.

4. Changing the risk category of the protected object to a higher or lower risk category in accordance with paragraph 3 of this Appendix is ​​allowed for no more than one level.

The risk category assigned to the protected object does not change if the protected object meets one or more of the conditions provided for in subparagraph "a" of paragraph 3 of this Appendix, and one or more conditions provided for in subparagraph "c" of paragraph 3 of this Appendix.

Main directions

The main directions of state fire supervision are control over: compliance with fire safety requirements by federal executive authorities, executive authorities of the constituent entities of the Russian Federation, local self-government bodies; compliance with fire safety requirements in the design, construction, overhaul, reconstruction of buildings and structures, expansion and technical re-equipment of enterprises and organizations; compliance with fire safety requirements during acceptance into operation of completed construction of buildings and structures; compliance with fire safety requirements during the operation of objects of control (supervision); compliance of manufactured, manufactured or sold products with the established fire safety requirements.

Organization of GPN activities

Supervision over compliance with fire safety requirements at objects of control (supervision) is carried out in the course of inspections carried out as part of control measures.

Checks are divided into planned and unscheduled.

Scheduled inspections are carried out in order to control the fulfillment of mandatory fire safety requirements at the objects of control (supervision).

Unscheduled inspections are carried out in order to control the fulfillment of orders to eliminate violations of mandatory fire safety requirements identified as a result of a scheduled inspection.

Unscheduled inspections are carried out by the state tax authorities also in the following cases: receipt of information from legal entities, individual entrepreneurs, public authorities about the occurrence emergency situations, about changes or violations technological processes, as well as on the failure of structures, equipment that can directly cause a threat to life, harm to human health, the environment and property of citizens, legal entities and individual entrepreneurs; the occurrence of a threat to life and harm to the health of citizens, damage to property, including in relation to other legal entities and (or) individual entrepreneurs; appeals of citizens, legal entities and individual entrepreneurs with complaints about violations of their rights and legitimate interests by actions (inaction) of other legal entities and (or) individual entrepreneurs, citizens related to their failure to comply with mandatory fire safety requirements, as well as other information confirmed by documents and other evidence indicating the presence of signs of such violations (appeals that do not allow to identify the person who applied to the GPN authority cannot serve as a basis for an unscheduled inspection).

Unscheduled inspections in the cases specified in paragraphs two and three of this clause may be carried out according to motivated decision body of the state tax authorities, including in relation to other legal entities and individual entrepreneurs using homogeneous objects of control (supervision).

Checks are carried out on the basis of the order (order) of the head of the GPN body.

The order (order) of the head of the GPN body to conduct an audit or a copy of it, certified by the seal of the relevant GPN body, is presented government inspector carrying out the inspection, the head or other official of a legal entity or an individual entrepreneur at the same time service certificates participants in the audit.

The inspection can be carried out only by those state inspectors who are indicated in the order (order) on the inspection.

The duration of measures to control fire safety in relation to one legal entity or individual entrepreneur should not exceed one month.

In exceptional cases related to the need to check a large number of buildings and structures, special studies(tests), examinations with a significant amount of work on the basis of a motivated proposal of the state inspector performing the inspection, by the head of the GPN body or his deputy, the period for carrying out the control measure may be extended, but not more than one month.

In accordance with the lists of objects of control (supervision), the state police bodies compile and maintain lists of especially important and sensitive objects, as well as lists of organizations where in mandatory a fire brigade is being created.

At the control objects included in the list of especially important and sensitive facilities and the list of enterprises where fire protection is created without fail, including those maintained at the expense of funds federal budget, scheduled inspections are carried out once every two years.

These facilities are assigned to the most trained state inspectors, and nuclear power facilities are assigned personally to the head of the relevant body of the GPN.

The frequency of scheduled inspections at objects of control (supervision) that are not included in the named lists, as well as in settlements established by the relevant authorities of the State Registration Service, taking into account the results of the analysis of the situation with fires and fire hazard objects, but not more often than once every two years.

The frequency of control measures on buildings and structures under construction is established by the GPN authorities, depending on the complexity of the facilities, the timing and pace of their construction and taking into account the schedule of execution construction works... These control measures should be carried out in the process of participation in the work of commissions for the commissioning of facilities under construction, but not more often than once every two years.

Inspections of federal executive bodies, executive bodies of constituent entities of the Russian Federation and local self-government bodies should be carried out at least once every 5 years.

When implementing control measures, special attention should be paid to objects with the presence of people (hotels, hostels, children's, educational, medical and recreational institutions, objects social security other).

Control activities are carried out by state inspectors during the performance of their duties with the participation of heads of organizations or their designated representatives.

Inspections of federal executive bodies, executive bodies of the constituent entities of the Russian Federation, local self-government bodies are carried out by a commission created by the relevant management body of the State Fire Service of the EMERCOM of Russia, headed by the head of this management body or, on his behalf, by another official of the State Fire Service of the Russian Emergencies Ministry.

Implementation of control measures
