Requirements for the provision of a land plot

A large family is a family with three or more minor children. The legislation establishes that in order to obtain the status of a large family, not only relatives are taken into account, but also children adopted in accordance with the established procedure.

The opportunity to obtain a land plot for such families appeared relatively recently; amendments to the law were made only in 2011.

Despite the fact that this privilege was introduced at the federal level, the conditions for obtaining a free land plot for large families largely depend on regional and local regulations.

You can join the queue for a land plot subject to the following legal requirements:

  • the family must be officially recognized as in need of better housing conditions;
  • the spouses must be in a registered marriage;
  • the family must have at least three children under the age of 18;
  • all family members must be registered at the same address;
  • at least one of the parents must have lived for at least five years in the place of the proposed land allocation.

The provision of this benefit to a large family is carried out once, and when submitting an application for queuing, it is necessary to indicate that there was no application for the allocation of land in the previous time.

You can get on the line to receive a land plot at the local administration, which owns the municipal land fund. In this case, you must comply with the requirement of the law on the minimum required period of residence in the specified area.

To confirm the status of a large family, as a rule, it is sufficient to present a birth certificate for each child (or a passport if the children have reached the age of 14).

However, local regulations may provide for a rule on the provision of a certificate of large families. Such a document, confirming that you are a large family, can be obtained from the social protection authorities or from the local administration.

Since 2015, the law allows a large family to be provided with an apartment instead of a land plot, while the grounds for queuing are approximately the same.

If applicants see that the prospect of obtaining land in the near future is very vague, they can apply for housing on social rent terms.

To do this, it is necessary to confirm the need for better housing conditions, as well as the status of a poor family. Determination of the need depends on the regional norms for the provision of housing, and the calculation of the income of low-income families is based on the indicators of the subsistence minimum.

What documents need to be provided

The family will be put in a queue for receiving land plots only upon presentation of a mandatory set of documents. The list of documentation includes:

  • application for a land plot and queuing up for land allocation;
  • parents' passports and birth certificates of children;
  • an extract from Rosreestr confirming that the applicants have not previously used the specified benefit;
  • a document confirming the period of residence in this area for at least five years;
  • certificate or certificate confirming the large number of children;
  • extracts from the USRN about the presence or absence of real estate in the family, including land plots;
  • an extract from a personal account or house book, confirming the registration of applicants at the same address.

How to write an application for a land plot correctly? First, it is necessary to study the list of land plots offered by the local administration for allocation to privileged categories of citizens.

The fact is that under this preferential program, land plots are often provided that do not have the necessary infrastructure or are located in hard-to-reach places.

An application for a land plot for large families must contain the following points:

  • passport details of the applicant and his contact details;
  • the address of receiving the land plot, as well as information about the cadastral quarter (this data can be obtained from the list of land plots posted on the official portals of local authorities);
  • the content of the request for the allocation of a plot for the construction of a private house;
  • date and signature of the applicant.

An application for a land plot for a large family is submitted to the local authority authorized to manage the lands of the municipal fund.

How to get in line to receive a land plot

To queue up for a land plot, large families must first collect a complete set of documents specified above.

One of the possible reasons for refusal to satisfy the application will be an incomplete set of documentation.

The algorithm of actions for queuing up for the allocation of land plots to large families consists of the following stages:

  • collection of the necessary documents and the choice of the territory for receiving the land plot;
  • registration of the application and its submission to the authorized authority;
  • verification of submitted documents;
  • making a positive decision on the inclusion of a large family in the queue for the allocation of land for building.

It should be borne in mind that filing an application does not mean that citizens will receive land within a few days. Land resources of local authorities are often limited for objective reasons.

In addition, at present the law prohibits the allocation of plots that are not equipped with the necessary infrastructure. Large families have the right to refuse such land.

Possible reasons for refusal

Improvement of living conditions for large families, that is, the allocation of land plots for building, may be refused if there are the following grounds:

  • violation of the procedure for submitting documents - incompleteness or inaccuracy of certificates and forms, as well as information in the application;
  • inaccurate information about the composition of the family (for example, the presence of children over the age of 18 on the list);
  • change of the family's place of residence, which deprives the right to receive land in the area.

If the indicated grounds are absent, the family will be queued for the allocation of a plot for the construction of a house.

Unlawful refusal to consider and satisfy the application may be appealed against in court. Also, local regulations allow the elimination of identified violations at the stage of verification of the application and submitted documents. If, by a court decision, the refusal is found to be illegal, the family will be queued from the date of the application.
