Now a lot is said and written in the media about state information systems and attempts to apply them in the life of Russian society. One of them is of increased interest - the state Information system on state and municipal payments (GIS GMP). One of the reasons for this attention is that the system does not work as intended.

The federal law "On the organization of the provision of state and municipal services" establishes the status of the GIS GMP: "The state information system on state and municipal payments is an information system designed to post and receive information about the payment by individuals and legal entities of payments for the provision of state and municipal services, services , specified in part 3 of article 1 and part 1 of article 9 of this Federal Law, payments that are sources of formation of budget revenues budget system Russian Federation, as well as other payments, in cases stipulated by federal laws ”(Article 21.3 210-FZ).

What do we expect from the system

In accordance with the law, the bodies providing public services and bodies providing municipal services are not entitled to require the applicant to “submit documents and information, including confirming the payment by the applicant for the provision of state and municipal services, which are at the disposal of bodies providing state services, bodies providing municipal services, other government agencies, bodies local government or organizations subordinate to state bodies or local self-government bodies participating in the provision of the stipulated part 1 of article 1 of this Federal Law on state and municipal services, in accordance with the regulatory legal acts Of the Russian Federation, regulatory legal acts of the constituent entities of the Russian Federation, municipal legal acts, with the exception of documents included in a certain part 6 of this article, a list of documents. That is, in ordinary language, the purpose of the GIS GMP is to give society a tool for faster and better quality provision to citizens and legal entities state and municipal services without a paper receipt and immediately after the fact of payment for these services. This was conceived by the founders, and on the basis of foreign experience.

How is this implemented with us? It can be said based on the experience of introducing GIS GMP in regional body state power (and in two versions: both "as another body" and as an administrator of income), that, despite the five-year history of 210-FZ and the three-year age of the GIS GMP itself, the system does not work, since it is not at all used by citizens and legal entities for getting them public services... Moreover, in its current form it cannot be used by them.

Reasons for failure

The first and, probably, the main reason is the weak methodological support of the GMF GIS. In federal government agencies, and even more so in the regions, there is no clear understanding of what specific information about charges for government services must be sent to the GIS GMP so that it works and meets its original goal. Each participant interprets the goals in his own way, the result is a "mess" of unnecessary information sent to the GIS GMP. When the attention of the participants is drawn to the uselessness of the information transmitted by them to the GIS GMP for citizens and legal entities, then in response they refer, as a rule, to the formal interpretation of the provisions of 210-FZ. Regulations and attempts federal bodies to clarify the issue at conferences and meetings only confuses the participants, because the conversations are about the same thing, which does not require any explanation: "traffic police fines, taxes and state duty."

At the moment, there is no regulatory document that defines mandatory list information sent by participants (primarily government agencies) to the GIS GMP to solve the problem of fast and high-quality provision of state and municipal services to citizens and legal entities. And without it, as mentioned above, the regions "drive garbage".

This also includes the lack of a publicly available up-to-date register of state and municipal services that can be used in the GIS GMP (although a whole section is devoted to this in 210-FZ). That is, the GIS GMP locomotive was launched, and the rails are being laid in the process of movement.

There is no normatively fixed responsibility of credit institutions for sending information on payment for state payments to the GIS GMP. services. As a result, in the regions, a large number of credit institutions do not interact with the GIS GMP. For example, one government agency sends information about charges to the GIS GMP, although it knows for sure that no information about payment will be there, since many banks used by citizens and legal entities are not connected to the GIS GMP.

In the existing regulatory documents (for example, in Order 19N of the Federal Treasury) there is no clear boundary between the powers of the participants. So, both the “other body” and the credit institution transmit information about the payment of public services. As a result, such a state “other body” and the banks with which it works duplicate information on the same payments in the GIS GMP.

Finally, there is no normatively fixed clarity regarding the mechanisms for using the state duty in the GIS GMP, that is, the so-called advance payments for public services. But this is the lion's share of state and municipal services.

The second reason is the weak organizational and technical support of the GIS GMP. In one of the regions there is a government agency - an aggregator that organizes the interaction of government agencies and municipal institutions with the GIS GMP. Through it, the work with the GIS GMP of some of the participants - government agencies - is gradually being established. And for credit institutions, the situation is different: every man for himself. And, since they have no serious responsibility for the transfer or lack of transfer of information to the GIS GMP, then there is practically no result in the region in terms of credit institutions. The latter either do not connect to the system, or transmit information that cannot be used, for example, without reference to charges. By the way, in order 19H there is a concept of "chief administrator of charges", which implies the aggregation of the transfer of information from participants, but it only applies to government agencies. So this organizational "bug" is fixed in the norm.

Provided by development firms software in view of the absence of clear requirements for format-logical control, the technology of information transfer to the GIS GMP is not observed. So, for example, "another body" of one of the regions transmits to the GIS GMP information about payment for public services provided by government agencies (for which they must make accruals) without a preliminary request to the GIS GMP UIN of charges for these state. services. As a result, “rubbish” flies into the GIS GMP again, and the state institutions will not receive any adjustments for their charges. Probably, the credit institutions of the region working with GIS GMP act in the same way.

Thus, at the moment, the GIS GMP is a repository of useless information that cannot be fully used by citizens and legal entities to obtain state and municipal services.

How to fix the situation?

To make GIS GMP needed by citizens and legal entities, first of all, it is necessary to create a publicly accessible register of state and municipal services intended for use in the GIS GMP information system. Moreover, this may be an electronic version of the register, which initially includes not all public services, which will be replenished in the future.

This register should be placed on state portal, access to which will be open for all participants of the GIS GMP. On the portal, it is necessary to implement convenient mechanisms for quick contextual search in the registry of a specific service, as well as highlighting the most frequently used services. The federal government body should be responsible for keeping the register up to date. The provision of public services using GIS GMP will be carried out on the basis of its presence in the register.

On the basis of the register of state and municipal services on the portal for GIS GMP participants, a service for the automatic generation of a unique service identifier (UID) should be implemented. The formation of the ICD should be carried out at the request of the participants of the GIS GMP. When providing accrued services, such requests will be sent by government agencies, in the case of services with an advance payment - by credit institutions. ICU identifies in the GIS GMP information about a specific service of a specific citizen or legal entity (either with an accrual or with an advance payment). To store UIN in GIS GMP data formats, you can use the existing field for UIN.

It is necessary to organize the basic infrastructure of GIS GMP in the regions of the Russian Federation. From the point of view of the provision of paid public services, two equally significant categories of GIS GMP participants can be distinguished: government agencies and credit institutions. Therefore, the most convenient and optimal from the point of view of costs would be to use the existing regional infrastructures of the Federal Treasury and Of the Central Bank... As regional aggregators, it is logical to use FC management for government agencies and regional branches of the Central Bank for credit institutions. FC and Central Bank in this case should carry out locally not only infrastructural, but also control functions (control of connection and regular sending of information by participants to the GIS GMP).

Mechanism of GIS GMP functioning

The first option is the provision of an accrued service. The government agency initiates the provision of government services to a citizen or legal entity (for example, it charges real estate tax). To do this, he turns to the portal to the register of state and municipal services, finds the appropriate service and, with the help of a special service, forms an ICD to provide services to a specific citizen or legal entity. Then the ICU is substituted into the information about the accrual, and the data is sent to the GIS GMP. A credit institution, when a citizen or a legal entity applies to pay for a service by the payer's identifier or immediately by the ICU, finds an accrual in the GIS GMP and sends information about payment with the specified ICU.

The second option is to provide a service with an advance payment. A credit institution, on the initiative of a citizen or legal entity, organizes payment for the provision of state or municipal services. To do this, the credit institution turns to the register on the portal, finds the appropriate service and, with the help of a special service, forms an ICD to provide services to a specific citizen or legal entity. Then the ICU is inserted into the information about the payment for the service, and this data is sent to the GIS GMP.

When a citizen or legal entity applies for the provision of a service, a state body finds information about payment in the GIS GMP by the payer's identifier or immediately by the ICU and sends information about the accrual with the specified ICU.

Thus, in the GIS GMP there is complete information for automatic or manual matching of accrual and payment. For their part, citizens and legal entities have the opportunity to use the GIS GMP to obtain information about the service.

In order to protect the GIS GMP from the flow of useless information, the requirements for the format-logical control of information entering the GIS GMP should provide for the control of the ICD for the mandatory presence, compliance with the structure of the register of state and municipal services and uniqueness. Moreover, if the ICU does not pass the format-logical control, the service should be provided and paid for in the usual way - without using the GIS GMP.

What is GIS GMP for a citizen? First of all, it is a tool for obtaining information on debts to the budget. Upon request, they are forwarded by competent authorities to interested parties.

The GIS GMP information system also allows not only citizens, but also organizations to receive information about what obligations they have to budgets at certain levels.

Functioning formats

The work in the system is carried out using the formats established by the Federal Treasury. There are quite a few of them, but consider the main and most demanded in practice:

  • Messages involved by the service.
  • Import, export, refinement or invalidation of system entities.
  • Request to GIS GMP, or general format.

Naturally, they are systematically adjusted and modernized by the developers of the Treasury.

Using identifiers

The main feature of the system is the use of various identifiers. Let's consider their features. Any notification sent to the GIS GMP operator must contain information about who pays and payment details. Payers can be both ordinary citizens and legal entities.

Individual identifiers include:

  • Insurance pension certificate number.
  • TIN number.
  • Details of the passport of a citizen of the Russian Federation.

  • FMS account code and other details allowed by Russian legislation.

The legal entity identifier can be:

So, having studied the system, it becomes clear that it is designed to increase the efficiency and reduce the labor costs of employees of the relevant services when considering issues related to money transfers of citizens or organizations in favor of the state.

In addition to the latter, active participants in the system include financial institutions, multifunctional centers, a public service portal, payment systems, income administrators, ordinary citizens and legal entities.

The creation of such a system as GIS GMP (state information system on state and municipal payments) is only welcome. And the main thing here is not at all that government agencies have no right to demand from the applicant a receipt for payment for services, and most importantly, in my opinion, in increasing the transparency of budget receipts at all levels for all participants budget process... Before the introduction of the GIS GMP, the Federal Treasury had information only about the receipt of payments to the budgets of all levels in accordance with the budget classification, but never had information about what actually should be received. Now, with the introduction of GIS GMP (if, of course, it works in full force), it will be possible to compare what should go to the budget (accrued) and what actually came (paid / credited). This provides completely new opportunities for administering budget revenues of all levels and obtaining a completely new level of analytical information for making decisions in the field of intergovernmental fiscal relations.

It is very correct that not only administrators of budget revenues, but also budgetary, autonomous and state institutions that provide services should post information about payments in the GIS GMP. Because they are recipients anyway budget funds and when planning a budget, it is necessary to have reliable information about their own income.

I will very briefly describe how the GMF GIS is conceived. Each administrator of incomes of budgets of all levels, as well as budgetary, autonomous and state institutions must post information on charges. Each charge is identified by the so-called UIN - a unique identifier of charges. Credit organizations (“fathers-grandparents” of the GIS GMP mean banks) turn to the GIS GMP, find the necessary accrual and place information on payment in the GIS GMP. The Federal Treasury "acknowledges" the paid charges, i.e. puts a mark on admission to the budget. Administrators of UIN income receive "feedback" on payment, enrollment and process it accordingly in their information systems - take into account overpayments, underpayments, charge penalties, fines, transfer information on non-payers to bailiffs, etc. Interaction with GIS GMP is carried out through SMEV using a web service specially developed for this purpose. Accordingly, for work, you need to perform a number of procedures for connecting both to the GIS of the GMP itself and to the SMEV.

In our municipality, we tested the work with GIS GMP at one institution. Everything is operational, but it is not yet possible to use it in a full-fledged mode for a number of reasons, the main of which is the lack of "stable feedback from credit institutions ". In our case, in particular, these are Sberbank of the Russian Federation and the Russian Post, through which more than 90% of payments pass.

In my subjective opinion, when creating a GIS GMP, a number of methodological errors were made that need to be corrected for its full-fledged functioning.

Several miscalculations are associated with credit institutions. At the level of the municipality, there are about 150-170 types (types) of charges that must be placed in the GIS GMP. There are exotic ones that can theoretically appear once every five years, or even less often, there are those that periodically appear once a quarter. The most critical for the municipality are monthly payments, such as - payment for childcare preschool, rent for rent municipal property, first of all, municipal premises, both residential under social rent agreements and non-residential, rented mainly by entrepreneurs. For these payments, penalties and fines are charged, and therefore information on payment should be received promptly, ideally immediately upon payment.

As I mentioned above, the main credit organizations that accept payments in the municipality are Sberbank of the Russian Federation and the Post of the Russian Federation. Both "offices" are "half-sovereigns", but neither one nor the other today work fully with the GIS GMP. I have no information on the state of affairs via the Russian Post Office. For Sberbank of the Russian Federation, the situation is as follows. Sberbank of the Russian Federation, with its huge and large-scale infrastructure, where several hundreds, or even thousands of payments per second are processed, cannot organize online interaction in the GIS GMP. The point here is most likely in the unsatisfactory for these purposes throughput SMEV and GIS GMP. Do not discount the fact that this is a "half-sovereign office" and has a certain amount of inertia and snobbery, which in this case let him down. In any case, for today they are trying to do something. To turn the tide, in particular, they are working to introduce offline interaction, mainly on taxes and fines from the traffic police, which makes it not easier for us at the municipal level when solving our problems. They work "crookedly" - as of today, they place the previously mentioned UIN in the payment purpose field, i.e. in the comments to the payment. That, in principle, destroys the entire harmonious structure of the GIS GMP and creates additional difficulties for everyone except Sberbank. But apparently there will be progress in this direction, since the federal treasury even developed specials for them. format in GIS GMP, which appeared in June.

The second problem is with credit institutions. There are many more of them than the federal treasury suggests. For example, at the municipal level we have a cash settlement center (RCC) for housing and communal services. Which carries out and charges for social rent. It is clear that he is obliged to place them in the GIS GMP. But the same RCC also collects funds, both through its cash desks and terminals, and under contracts with enterprises and organizations when deducting rent from salaries. Those. in fact, the RCC Housing and Utilities Center is both an “administrator” of income and a credit institution. As in other things, every institution that transfers the rent for an employee is also a credit institution. Those. the circle of credit organizations is much wider.

In fact, we have - GIS GMP is much larger than even the same SBOL (Sberbank-on-line) and is a payment system throughout the country. Accordingly, such a system should also be subject to the corresponding requirements for communication channels, the power of computing resources and the software used.

In addition, GIS GMP is a real-time system. One of the problems that has risen in full growth is the interaction with the GIS GMP when paying the state duty in the registry offices. If earlier the applicant came with a receipt for payment of the state duty and wrote a statement, now everything should look something like this - he submitted an application, the registry office employee entered the information into the GIS GMP, went into the lobby (to the nearest ATM) and paid. Returned, and the information is already with the employee of the registry office. In my opinion, it is absolutely unrealistic. An alternative is to issue documents to the registry office without receiving information about the payment of the state duty. Which is fraught with non-payments and an extra burden on the bailiff service.

From all that has been said above, I believe that the use of SMEV as a transport when interacting with GIS GMP is not justified due to the huge amount of information that does not correspond to the purposes for which SMEV was created. But it would be criminal not to use the communication channels used by SMEV, because the alternative is to create the same parallel secure network with the costs of its creation and maintenance.

Another "methodological" miscalculation. It is clear that the “forefathers” of the GIS GMP wanted to avoid problems with personal data as much as possible, and in the accrual they, by default, identify a person by SNILS plus another 12-15 alternative documents. Well, how can the same credit institution work when I come and say I Ivanov, well, look what I owe there to the state / municipality? And in response to me - would you be so kind as to tell your SNILS? I am not obliged to remember it and carry it with me. Well, not a problem, with the right approach, you can also request through SMEV, although also with difficulty - there are many namesakes. And if I was charged in one place according to SNILS, a traffic police fine was written out according to a driver's license, is there something else there according to 12-15 documents? Yes, in life, no credit organization will collect all my charges, dangling in the GIS GMP, drawn up for various documents. And I just may not know on what document I was "owed" to the GIS GMP. As a result, I will turn out to be a malicious defaulter and will be puzzled by me bailiffs, who already have work above the roof, and even I will not be released abroad. So this is not good either. What if I want to pay for my mother (grandmother) in the hospital? But here we come back again to the problem of identification. In my opinion, SNILS, chosen at PSU as an identifier, is not quite the correct solution, but this is purely my opinion. But one day, a wrongly chosen solution will always stand "a bone in the throat."

A few more words about connecting administrators at the municipal level to the GMP GIS. There are several options for connecting charge administrators to the GIS GMP, incl. and through the so-called aggregators. But an aggregator can only be a local self-government body, when, in fact, financial bodies - financial departments, financial departments, etc., are engaged in organizing the budget process locally, and they, in accordance with budget code cannot be a local government body. As a result, local financiers will have less information about the actual state of affairs in the field of income than the federal treasury, especially in cases when “everyone is for himself,” that is, each institution and the administrator of income independently interact with the GIS GMP. In my opinion, there are two ways to fix this - to force everyone (at the level of the municipality) to interact with the GIS GMP only through the financial organ. And the second, less preferable (due to the increase in traffic), to enable financial agencies to receive from the GIS GMP all information about charges and receipts from all institutions and administrators local budget located on their territory. There is another solution to the problem, to make an intermediate link when interacting with the GIS GMP - one per municipality, regardless of the chosen scheme of connection to the GIS GMP. And all interaction should be carried out only through him. There is a complete understanding of how this can and should be done.

These are, in my subjective opinion, the main problems, without the solution of which, although it is “beautifully conceived, but the GMF GIS will not fly. And so the system is quite functional - we touched it, we know. But we will not use it, we will work "the old fashioned way". Better the old time-tested accounting systems than the new ones rebuilt according to clear logic, but for a number of reasons that are completely beyond our control and are not workable.

There are also various little things, such as the formation of UIN for budgetary, autonomous / state institutions, but this is all fixable "in the course of the play", of course, if you look a little ahead and be puzzled by the possibility of obtaining all kinds of analytics at further stages.

To optimize the work of state organizations with citizens and other enterprises on the issues of making various payments to the budget, the legislation of the Russian Federation had a special system. What is GIS GMP, and how it works, we will consider in this article.

Concept

The state information system on state and municipal payments (hereinafter - GIS GMP) is designed so that government agencies that provide a certain list of services can turn to it to find out the fact of payment tax collection or fees by an individual for these services. Besides, state organizations or the municipality, having transferred the amount to be sent by an individual to the budget, must promptly send the information necessary for transferring money to the system.

Based on this, the transfer of data to the GIS GMP relieves organizations of the obligation to request from a citizen documents on payment of a duty or fee.
