The Problems of the Development and Approval Projects of the Conservation Zones of Cultural Heritage in Federal Cities

This article deals with the problems connected with the development and with the approval of the projects of the conservation zones of cultural heritage (further CZCH) in federal cities of Moscow and St.-Petersburg. The importance of this theme is provided by the imperfection of the legislation regulating of these issues. The article has the analysis of the federal and regional legislation; the different features of usage modes and town-planning regulations for CZCH. The problems of the responsibility for infractions of the requirements of the preservation and usage of CZCH; the order and features of the development projects of zones, including the problems of the development and adoption of the new Town-planning code of the Russian Federation are considered in this article. In order to disclose the problem the history of the development of the research process, the accommodation and the approval of conservation zones of cultural heritage and the concept of development of projects CZCH in Moscow and St.-Petersburg during the last years is considered in this article, we can also find here the statistics of the Department of a cultural heritage of Moscow. It is important to notice that this article has not only theoretical value, but also the practical application at that reason that concrete measures on legislation improvement are offered in it.

Cultural heritage sites

The cultural heritage of any settlement requires reverent attention and preservation in the environment and locality where it was originally formed and located. Therefore, in order to ensure the safety and full-fledged existence of cultural heritage objects, the legislation provides for the presence of protected zones, where human activities will be regulated.

The boundaries of protected zones represent territories within which any human activity, especially if it is not controlled by special bodies, can lead to a negative impact on a historical and cultural monument and its environment. They are not always the same as administrative division or borders land plots.


Federal Law "On Cultural Heritage Objects (Historical and Cultural Monuments) of the Peoples of the Russian Federation" of June 25, 2002 N 73-FZ (as amended in 2017):

3. The boundaries of the protection zone of the cultural heritage object are established:

1) for a monument located within settlement, at a distance of 100 meters from the outer borders of the territory of the monument, for a monument located outside the boundaries of the settlement, at a distance of 200 meters from the outer borders of the territory of the monument;

2) for an ensemble located within the boundaries of a settlement, at a distance of 150 meters from the outer boundaries of the territory of the ensemble, for an ensemble located outside the boundaries of a settlement, at a distance of 250 meters from the outer boundaries of the territory of the ensemble.

4. In the absence of the approved boundaries of the territory of the cultural heritage object located within the boundaries of the settlement, the boundaries of the protective zone of such an object are set at a distance of 200 meters from the line of the outer wall of the monument or from the line of the general outline of the ensemble formed by connecting the outer points of the most distant elements of the ensemble, including park area. In the absence of the approved boundaries of the territory of the cultural heritage object located outside the boundaries of the settlement, the boundaries of the protective zone of such an object are set at a distance of 300 meters from the line of the outer wall of the monument or from the line of the general outline of the ensemble formed by connecting the outer points of the most distant elements of the ensemble, including the park area ...

5. Regional body protection of cultural heritage objects has the right to make a decision providing for the establishment of the boundaries of the protection zone of the cultural heritage object at a distance different from the distances provided for in paragraphs 3 and 4 of this article, based on the conclusion historical and cultural expertise taking into account the historical, urban planning and landscape environment of such an object of cultural heritage in the manner established by the Government Russian Federation.

6. Protective zone cultural heritage object ceases to exist from the date of approval in the manner prescribed by Article 34 of this Federal law, the project of protection zones for such an object of cultural heritage ...



Zones of protection of cultural monuments

The project of protection zones for cultural heritage objects (historical and cultural monuments) of the peoples of the Russian Federation, establishes requirements for the regimes of land use and general principles establishing requirements for urban planning regulations within the boundaries of the territories of the indicated zones.

On the territory adjacent to a cultural heritage site included in a single State Register cultural heritage objects (historical and cultural monuments) of the peoples of the Russian Federation, one or more protection zones can be established in its historical environment: a security zone, a development regulation zone and economic activity, a zone of a protected natural landscape.

When developing projects for the protection zone of cultural heritage monuments, they define the boundaries of the zones and the regulations for their use:

  • The territory of the object is the territory that ensures the full preservation of the OKN and restricts the use of the territory, directing the activities of people strictly towards the preservation of the object.
  • Protected zone - an area where activities are carried out to ensure the safety of an object in its natural surroundings and familiar landscape; where the use of land and economic activities of the people living there are limited. The zone where, any construction works... In addition to measures aimed at preserving or restoring the cultural monument itself.
  • The zone of regulation of development and economic activity strictly limits the construction and repair of structures located near the protected object. Land use also has significant restrictions. All human activities depend on the state of the cultural monument, which cannot be harmed.
  • A protected landscape zone is a territory in which a special regime is established. The possibility of using land is limited, housekeeping is prohibited. The only exceptions are special events, the purpose of which is to preserve the natural landscape (reservoirs, forest plantations, individual natural details or open space) that make up a composition with a cultural monument.



Protection zones projects

The project of the protection zones of the OKN consists of text files, drawings of structures within the boundaries of this zone, projects for the use of the territory for economic purposes local population, maps or diagrams, thanks to which it is possible to determine the boundaries on the basis of the collected substantiating and archival materials.

The project of protection zones must undergo a state historical and cultural examination for compliance with the requirements of legislation and regulations for the protection of cultural heritage objects. Only the permission of the historical and cultural expertise will make it possible to approve the boundaries of the zones that need protection.

The project of the protected zones is obligatory for submission for approval to the relevant organizations along with the materials that serve as its justification, including the expert opinion.

The boundaries of the protection zones of the OKN are approved and established only if the project receives a positive expert opinion and appropriate approvals from the authorities.

INTRODUCTION

This Collection 8.2 “Projects of zones for the protection of cultural heritage objects. МРР-8.2-16 "(hereinafter - the Collection) was developed in accordance with the state assignment.

This Collection is intended for use government customers, design and other interested organizations when calculating the initial (maximum) contract prices and determining the cost of developing projects for protection zones of cultural heritage sites, carried out with the involvement of funds from the budget of the city of Moscow.

When developing the Collection, the following regulatory and methodological documents were used:

Federal Law of June 25, 2002 No. 73-FZ “On objects of cultural heritage (historical and cultural monuments) of the peoples of the Russian Federation;

Decree of the Government of the Russian Federation of September 12, 2015 No. 972 "On approval of the Regulations on the protection zones of cultural heritage objects (historical and cultural monuments) of the peoples of the Russian Federation and on the recognition as invalid of certain provisions of regulatory legal acts of the Government of the Russian Federation";

Decree of the Moscow Government dated December 16, 1997 No. 881 “On the approval of the protection zones of the central part of Moscow (within the Garden Ring)”;

Decree of the Moscow Government dated July 7, 1998 No. 545 "On the approval of the protection zones of the central part of Moscow (within the Kamer-Kollezhsky Val)";

Decree of the Moscow Government dated December 28, 1999 "On the approval of zones for the protection of historical and cultural monuments in Moscow (on the territory between Kamer-Kollezhsky Val and the administrative boundary of the city)";

Resolutions of the Moscow Government dated July 25, 2000 No. 566-PP "On the conduct of a historical and architectural survey of Moscow" in accordance with the "Guidelines for the design of protection zones, land use regimes and urban planning regulations within the boundaries of cultural heritage protection zones", approved by Rosokhrankultura and approved by the order of the Moscow Heritage Committee No. 9 dated August 02, 2010;

1. GENERAL PROVISIONS

1.1. This Collection is a methodological basis for determining the cost of developing projects for protection zones of cultural heritage objects in the city of Moscow.

1.2. When determining the cost of work on the basis of this Collection, you should also be guided by the provisions of the collection 1.1 "General instructions for the application of Moscow regional recommendations. MPP-1.1-16 ".

1.3. Bringing the base cost of work, determined in accordance with this Collection, to the current price level is carried out by applying the conversion factor (inflationary change), approved in accordance with the established procedure.

1.4. Establishment and updating of the boundaries of zones of protection of cultural heritage objects are carried out on the basis of historical and cultural research, the cost of which is determined on the basis of Collection 8.1 "Historical and Cultural Research".

1.5. This Collection presents basic prices for the following works:

Preliminary work;

Development of materials to substantiate the project of protection zones for cultural heritage objects:

a) analysis of the historical and cultural characteristics of the study area;

b) analysis of the current urban planning documentation;

Development of materials for the project of zones of protection of cultural heritage objects:

Project of protection zones for cultural heritage objects;

Development of proposals for land use regimes.

1.6. The basic prices of the Collection take into account and do not require additional payment the costs of performing the work listed in clauses 3.3-3.5 MPR-1.1-16.

1.7. The following works are not taken into account in the base prices and require additional payment (subject to the inclusion of these works in the design assignment:

Development of the project of the boundaries of the territory and the project of the subject of protection of the cultural heritage object (the cost of these works is determined on the basis of Digest 9.1 "Methodology for calculating the cost of scientific, regulatory, methodological, design and other types of work (services) based on standardized labor costs. МРР-9.1-16);

Work on the preparation of information on the zones of protection of cultural heritage sites in in electronic format(The cost of these works is determined on the basis of Collection 9.5. "Collection of basic prices for work on the production of demonstration materials. MPR-9.5-16";

Preparation of land management documentation for the registration of protection zones of cultural heritage sites, the territory of cultural heritage sites and identified cultural heritage sites;

Analysis of the visual perception of objects (the cost of these works is determined on the basis of Digest 8.3 "Visual landscape analysis. MPR-8.3-16"), taking into account the reduction factor for the scope of work as agreed with the customer.

1.8. Development of technical specifications and collection of initial data refers to the functions of the customer and, when entrusting these works to the contractor, their cost is determined additionally. Payment of costs is made at the expense of funds for the maintenance of the customer.

1.9. The basic prices of the Compendium also do not take into account the associated costs listed in clause 3.6 of MPP-1.1-16.

2. METHODOLOGY FOR DETERMINING THE COST OF WORKS

2.1. The base cost of work on the development of projects for protection zones of cultural heritage sites is calculated on the basis of base prices using the formula:

C (b)- the base cost of work for one object (rubles);

C (b)- base price of work performance (rubles);

The product of all the coefficients K i, except for the coefficient taking into account the reduction in design time, should not exceed the value of 2.0;

Wed- a correction factor that takes into account the degree of completeness of work (determined by calculation based on the scope of work presented in Tables 3.2-3.6).

2.2. The coefficient taking into account the completeness of the work (K cf) is determined by the formula:

Di- share certain types works from the total cost of works (according to tables 3.2-3.6);

K ki- the degree of completeness of the study of certain types of work (determined in terms of reference or as agreed with the customer).

2.3. The values ​​of the base prices are presented in the tables, taking into account the categories of complexity of the object or type of work.

The factors affecting the labor intensity of work include:

Development area;

Complexity of the territory, including:

Concentration of cultural heritage objects and their protection zones, as well as valuable objects of the historical urban planning environment;

The degree of preservation of the historical urban planning environment;

Early period of territory development;

Presence of previously developed pre-design documentation that determines the restrictions on the development of the territory.

Regulations on protection zones of cultural heritage objects

(historical and cultural monuments) of the peoples of the Russian Federation

1. This Regulation establishes the procedure for the development of projects for protection zones of cultural heritage objects (historical and cultural monuments) of the peoples of the Russian Federation (hereinafter referred to as cultural heritage objects), requirements for land use regimes and town planning regulations within the boundaries of these zones.

2. On the territory adjacent to the cultural heritage object, one or several protection zones may be established: a buffer zone, a zone of regulation of development and economic activity, a zone of a protected natural landscape.

The required composition of the protection zones of the cultural heritage object is determined by the corresponding project.

3. The project of protection zones of a cultural heritage object is documentation in text form and in the form of maps (diagrams) containing a description of the boundaries of the projected zones and the boundaries of the territories of cultural heritage objects located in the indicated zones, draft regimes of land use and town planning regulations within the boundaries of these zones ...

The boundaries of the zones of protection of the cultural heritage object are the lines denoting the territory, outside of which the implementation of urban planning, economic and other activities does not directly or indirectly negative impact on the preservation of this cultural heritage object in its historical environment.

The boundaries of the protection zones of the cultural heritage object may not coincide with the boundaries of the territorial zones and the boundaries of land plots.

4. Development of projects for protection zones of cultural heritage objects is carried out at the initiative of the authorities state power, bodies local government, owners or users of cultural heritage objects, rights holders of land plots or by a court decision.

The development of projects for protection zones of cultural heritage objects can also be carried out at the initiative of legal entities, public and religious associations, whose statutory activities are aimed at preserving cultural heritage objects.

5. Development of projects for protection zones of cultural heritage objects can be included in the corresponding federal and regional target programs for the conservation, use, popularization and state protection cultural heritage sites.

6. Development of projects for protection zones of cultural heritage objects is carried out by physical or legal entities on the basis of the necessary historical and architectural, historical and urban planning, archival and archaeological research (hereinafter referred to as historical and cultural research), data from the state cadastre of real estate and materials on the justification of projects for protection zones of cultural heritage objects.

Draft regimes of land use and town planning regulations within the boundaries of zones of protection of cultural heritage objects are developed taking into account the requirements specified in clauses 10-12 of this Regulation.

7. Materials for substantiation of the project of protection zones of the cultural heritage object include:

a) information about the cultural heritage object entered in the unified state register of cultural heritage objects (historical and cultural monuments) of the peoples of the Russian Federation in accordance with Article 20 of the Federal Law "On cultural heritage objects (historical and cultural monuments) of the peoples of the Russian Federation";

b) a report on the conducted historical and cultural research;

c) information in text form and in the form of maps (diagrams) about other objects of cultural heritage located within the boundaries of the projected zones, their territories and protection zones;

d) information in text form and in the form of maps (diagrams) about the identified objects of cultural heritage located within the boundaries of the projected zones;

e) information in text form and in the form of maps (diagrams) about the visual perception of the cultural heritage object from the main viewpoints and observation platforms;

f) information on the compositional relationship with the cultural heritage of the natural landscape located within the boundaries of the projected zones, as well as on the combination of certain types of terrain, water bodies, soils, vegetation in it;

g) other materials necessary for the substantiation and development of the project of protection zones of the cultural heritage object.

8. The composition and content of the materials specified in clause 7 of these Regulations are determined on the basis of historical and cultural research.

The materials on the substantiation of the project of the protection zones of the cultural heritage object located on the territory of the historical settlement, specified in subparagraphs "c", "d" and "e" of clause 7 of these Regulations, can be presented in the form of a historical and cultural reference plan containing relevant information or its fragment.

9. The Federal Service for Supervision in the Sphere of Mass Communications, Communications and Protection of Cultural Heritage provides methodological explanations for the conduct of historical and cultural research, the preparation of materials specified in clause 7 of these Regulations, and the development of projects of zones for the protection of cultural heritage objects on their basis.

10. Special regime land use and town planning regulations within the boundaries of the buffer zone are established taking into account the following requirements:

a) prohibition of construction, except for the application special measures aimed at preserving and restoring (regenerating) the historical and urban planning or natural environment of the cultural heritage object;

b) limitation of overhaul and reconstruction of facilities capital construction and their parts, including those concerning their sizes, proportions and parameters, the use of individual building materials, the use of color solutions, features of details and small architectural forms;

c) restriction of economic activities necessary to ensure the safety of the cultural heritage object, including the prohibition or restriction of the placement of advertisements, signboards, buildings and objects (parking lots, temporary buildings, kiosks, sheds, etc.), as well as the regulation of work on landscaping;

d) provision fire safety an object of cultural heritage and its protection from dynamic influences;

e) preservation of hydrogeological and ecological conditions necessary to ensure the preservation of the cultural heritage object;

f) improvement of the territory of the protected zone, aimed at preserving, using and popularizing the cultural heritage object, as well as preserving and restoring the town-planning (planning, typological, large-scale) characteristics of its historical, town-planning and natural environment;

g) other requirements necessary to ensure the preservation of the cultural heritage object in its historical and landscape environment.

11. The mode of land use and town planning regulations within the boundaries of the zone of regulation of development and economic activity are established taking into account the following requirements:

a) construction restrictions necessary to ensure the preservation of a cultural heritage object, including those concerning the size, proportions and parameters of capital construction objects and their parts, the use of certain building materials, the use of color schemes;

b) limitation of overhaul and reconstruction of capital construction objects and their parts, including those concerning their sizes, proportions and parameters, the use of certain building materials, the use of color solutions;

c) preservation of the historically established boundaries of land plots, including limiting their change during land management, as well as the division of land plots;

d) ensuring visual perception of a cultural heritage object in its historical and urban planning and natural environment;

e) restriction of economic activities necessary to ensure the safety of the cultural heritage object, including the prohibition or restriction of the placement of advertisements, signboards, buildings and objects (parking lots, temporary buildings, kiosks, sheds, etc.), as well as the regulation of work on landscaping;

f) ensuring the fire safety of the cultural heritage object and its protection from dynamic influences;

g) preservation of hydrogeological and ecological conditions necessary to ensure the preservation of the cultural heritage object;

h) ensuring the safety of all historically valuable town-forming objects;

i) other requirements necessary to ensure the safety of the cultural heritage object.

12. The mode of land use and town planning regulations within the boundaries of the protected natural landscape zone are established taking into account the following requirements:

a) prohibition or restriction of economic activity, construction, overhaul and reconstruction of capital construction objects and their parts in order to preserve and restore the compositional relationship with the cultural heritage object of the natural landscape, including river valleys, reservoirs, forests and open spaces;

b) ensuring fire safety of the protected natural landscape and its protection from dynamic influences;

c) preservation of hydrological and ecological conditions necessary to ensure the preservation and restoration (regeneration) of the protected natural landscape;

d) preservation and restoration of the existing ratio of open and closed spaces in the protected natural landscape in order to ensure the visual perception of the cultural heritage object in its historical, urban planning and natural environment;

e) other requirements necessary for the preservation and restoration (regeneration) of the protected natural landscape.

13. The project of protection zones of a cultural heritage object is subject, in accordance with the established procedure, to the state historical and cultural expertise in order to determine its compliance with the requirements of state protection of cultural heritage objects.

The positive conclusion of the state historical and cultural expertise is the basis for approving the boundaries of the protection zones of the cultural heritage object, land use regimes and town planning regulations within the boundaries of these zones.

14. The project of protection zones of the cultural heritage object is submitted to the relevant state authority or local self-government body together with materials on its justification and a positive conclusion of the state historical and cultural expertise.

15. Based on the project of protection zones of the cultural heritage object federal significance, recognized as a particularly valuable object of cultural heritage of the peoples of the Russian Federation or included in the World Heritage List, and a positive conclusion of the state historical and cultural expertise Federal Service for Supervision of Mass Communications, Communications and Protection of Cultural Heritage in agreement with Federal Agency on construction and housing and communal services and the relevant state authority of the constituent entity of the Russian Federation approves the boundaries of the protection zones of the corresponding cultural heritage object, as well as specific requirements for the regimes of land use and town planning regulations within the boundaries of these zones. At the same time, the boundaries of the zone of a protected natural landscape, as well as specific requirements for the regime of land use and urban planning regulations within the boundaries of this zone are subject to agreement with Federal Service on supervision in the field of nature management.

16. On the basis of the project of protection zones of a cultural heritage object of federal significance and a positive conclusion of the state historical and cultural expertise, the relevant state authority of the constituent entity of the Russian Federation approves, in agreement with the Federal Service for Supervision of Mass Communications, Communications and Cultural Heritage Protection, the boundaries of the protection zones of the cultural property. heritage (except for the boundaries of zones of protection of a particularly valuable object of cultural heritage of the peoples of the Russian Federation or an object of cultural heritage included in the World Heritage List), land use regimes and town planning regulations within the boundaries of these zones.

17. On the basis of the project of protection zones of a cultural heritage object of regional significance or a project of protection zones of a cultural heritage object of local (municipal) significance and a positive conclusion of the state historical and cultural expertise of the boundaries of protection zones of the corresponding cultural heritage object, regimes of land use and town planning regulations within the boundaries of these zones approved in the manner prescribed by the law of the constituent entity of the Russian Federation, on the territory of which the given object of cultural heritage is located.

18. Information on the presence of protection zones of a cultural heritage object is entered in the prescribed manner in the unified state register of cultural heritage objects (historical and cultural monuments) of the peoples of the Russian Federation and in the prescribed manner is submitted to the body carrying out activities for maintaining the state cadastre of real estate.

Restrictions (encumbrances) of rights to land arising on the basis of a decision on the establishment of zones of protection of a cultural heritage object are subject to state registration.

19. The state authority that approved the boundaries of the protection zones of the cultural heritage object, the regimes of land use and urban planning regulations within the boundaries of these zones, shall send, within 7 days from the date of approval, a copy of the decision on the establishment of protection zones for the cultural heritage object to the relevant local government of the city district or municipal district, on the territory of which the zones provided by the specified project are located.

The state authority or local self-government body, which approved the boundaries of the zones of protection of the cultural heritage object, the regimes of land use and town planning regulations within the boundaries of these zones, shall, in accordance with the rules for organizing document flow, record and store all received documents and materials related to the establishment of zones.

20. Information on the approved boundaries of the protection zones of the cultural heritage object, modes of land use and town planning regulations within the boundaries of these zones in mandatory placed in information systems for urban planning activities.

The approved boundaries of the protection zones of the cultural heritage object, land use regimes and urban planning regulations within the boundaries of these zones are necessarily taken into account and displayed in the documents of territorial planning, land use and development rules, territory planning documentation (if necessary, in specified documents changes are made in the prescribed manner).

21. In the event that protection zones of a cultural heritage object of federal, regional or local (municipal) significance are established within the territories of protection zones of a particularly valuable object of cultural heritage of the peoples of the Russian Federation or an object of cultural heritage included in the World Heritage List, the regimes operate in these territories land use and town planning regulations established within the boundaries of the zones of protection of a particularly valuable object of cultural heritage of the peoples of the Russian Federation or an object of cultural heritage included in the World Heritage List.

22. In the event that protection zones of a cultural heritage object of regional or local (municipal) significance are established within the territories of protection zones of a cultural heritage object of federal significance, the regimes of land use and town planning regulations established within the boundaries of zones of protection of a cultural heritage object of federal significance are established in these territories. ...

23. In the event that protection zones of a cultural heritage object of local (municipal) significance are established within the territories of protection zones of a cultural heritage of regional significance, the regimes of land use and town planning regulations established within the boundaries of zones of protection of a cultural heritage of regional significance are in effect in these territories.

24. When assigning an object real estate, located within the territories of protection zones of the cultural heritage object, to the monuments of history and culture, the previously approved boundaries of the protection zones of the cultural heritage object, modes of land use and town planning regulations within the boundaries of these zones are subject to the necessary clarification in the manner prescribed by paragraph 28 of this Regulation.

25. The land plots or capital construction objects located within the territory of the protection zones of the cultural heritage object, the types of permitted use, the limiting (minimum and (or) maximum) dimensions and limiting parameters of which do not correspond to the regimes of land use or urban planning regulations established within the boundaries of these zones , can be used without setting a time limit for bringing them into line with the specified modes of land use or town planning regulations (except for cases where the use of such land plots and capital construction projects is dangerous to human life or health, for the environment, cultural heritage sites).

Reconstruction of these capital construction facilities and their parts can be carried out only by bringing such facilities into compliance with the land use regimes and urban planning regulations established within the boundaries of the protection zones of the cultural heritage object, or by reducing their inconsistency with the established limit parameters of the permitted construction.

Changes in the types of permitted use of these land plots and capital construction objects can be carried out only by bringing them into line with the types of permitted use of land plots and capital construction objects, provided for by land use regimes and urban planning regulations established within the boundaries of the protection zones of the cultural heritage object.

26. The rightholders of land plots, capital construction objects or their parts, if their rights and legitimate interests violated or may be violated as a result of the approval of the boundaries of the protection zones of the cultural heritage object, the regimes of land use and town planning regulations within the boundaries of these zones, has the right to challenge the decision on their approval and (or) the corresponding project of the protection zones of the cultural heritage object in judicial procedure.

27. State authorities and local self-government bodies have the right to challenge in court the decision to approve the boundaries of the protection zones of the cultural heritage object, land use regimes and town planning regulations within the boundaries of these zones in the event that the project of the protection zones of the cultural heritage object does not comply with the legislation of the Russian Federation.

28. Changing the protection zones of the cultural heritage object, including their boundaries, land use regimes and town planning regulations within the boundaries of these zones, is carried out by developing a new project for the protection zones of the cultural heritage object in the manner prescribed by this Regulation.

29. Compliance with the regimes of land use and town planning regulations within the boundaries of the zones of protection of cultural heritage objects is mandatory in the implementation of town planning, economic and other activities.

ABOUT PROTECTION ZONES OF OBJECTS OF CULTURAL HERITAGE (MONUMENTS

HISTORY AND CULTURE) OF THE PEOPLES OF THE RUSSIAN FEDERATION

1. This Regulation establishes the procedure for the development, coordination and approval of the project of zones for the protection of cultural heritage objects (historical and cultural monuments) of the peoples of the Russian Federation (hereinafter referred to as cultural heritage objects), the project of a united zone for the protection of cultural heritage objects, requirements for land use regimes and general principles establishing requirements for urban planning regulations within the boundaries of the territories of the indicated zones.

2. On the territory associated with a cultural heritage object included in the unified state register of cultural heritage objects (historical and cultural monuments) of the peoples of the Russian Federation, one or several protection zones may be established in its historical environment: a security zone, a zone of regulation of development and economic activities, protected natural landscape zone.

In order to simultaneously ensure the preservation of several cultural heritage objects in their historical environment, it is allowed to establish a single protected zone for these cultural heritage objects, a single zone for regulating development and economic activities and a single zone of a protected natural landscape (hereinafter referred to as a joint protection zone for cultural heritage objects).

3. Development of projects for protection zones of cultural heritage objects, a project of a united protection zone for cultural heritage objects is carried out by individuals or legal entities on the basis of materials from historical and architectural, historical, urban planning and archival research (hereinafter referred to as historical and cultural research), as well as using data from the state real estate cadastre, if any.

4. The composition of protection zones for cultural heritage objects is determined by the project of protection zones for cultural heritage objects, developed on the basis of materials of historical and cultural research, in which the need to develop a project of protection zones in relation to one cultural heritage object or a project of a united protection zone for cultural heritage objects is substantiated.

Materials of historical and cultural research are formed on the basis of the following data:

the historical and cultural base plan of the settlement on the territory of which the cultural heritage object or a group of cultural heritage objects is located, or a fragment of the said plan;

information about cultural heritage objects, identified cultural heritage objects, established territories and zones of protection of cultural heritage objects located on the territory of the proposed design of protection zones, in relation to which historical and cultural research has been carried out;

materials of previously developed projects of protection zones for cultural heritage sites located in the territory of a settlement in respect of which historical and cultural research has been carried out, or in inter-settlement territories if historical and cultural research has been carried out in relation to a separately located cultural heritage site;

materials of landscape-visual analysis of compositional links of the object (objects) of cultural heritage, surrounding buildings and landscape environment;

other materials necessary for the substantiation and development of the project of protection zones for cultural heritage objects.

5. The decision to develop a project for a united protection zone of cultural heritage objects is taken by the authorities executive power constituent entities of the Russian Federation, and in relation to cultural heritage sites of federal significance recognized as especially valuable cultural heritage sites of the peoples of the Russian Federation or included in the World Heritage List - by the Ministry of Culture of the Russian Federation.

6. The project of protection zones of the cultural heritage object and the project of the united protection zone of cultural heritage objects are documentation in text form and in the form of maps (diagrams) of boundaries, containing a description of the boundaries of the projected zones and the boundaries of the territories of cultural heritage objects located in the indicated zones, draft regimes land use and requirements for urban planning regulations within the boundaries of these zones.

The boundaries of the protection zones of the cultural heritage object are the lines denoting the territory beyond which the implementation of urban planning, economic and other activities does not have a direct or indirect negative impact on the safety of this cultural heritage object in its historical environment. The designation of these lines, as well as the coordinates of the characteristic points of the boundaries of the protection zones of the cultural heritage object on maps (diagrams) should allow to unambiguously determine the boundaries of the protection zones of the cultural heritage object with the normative value of accuracy provided for maintaining the state cadastre of real estate.

The boundaries of the protection zones of the cultural heritage object may not coincide with the boundaries of the territorial zones and the boundaries of land plots.

7. Development of projects for protection zones of cultural heritage objects and projects of a united protection zone for cultural heritage objects, materials of historical and cultural research justifying the need to develop projects for protection zones of cultural heritage objects, is included in the corresponding federal and regional target programs, which provide for conservation measures, use, popularization and state protection of cultural heritage objects.

The development of projects for protection zones of cultural heritage objects and projects of a united protection zone for cultural heritage objects can also be carried out on the initiative and at the expense of local authorities, owners or users of cultural heritage objects, right holders of land plots located within the boundaries of cultural heritage protection zones.

The development of projects for protection zones for cultural heritage objects and projects for a united protection zone for cultural heritage objects shall be organized by the Ministry of Culture of the Russian Federation, state authorities of the constituent entities of the Russian Federation and local self-government bodies.

8. The Ministry of Culture of the Russian Federation gives guidelines on the preparation of the materials specified in paragraph 4 of these Regulations, and the development on their basis of projects of protection zones of cultural heritage objects, projects of a united protection zone of cultural heritage objects, determines the procedure for approval (and in the case specified in paragraph 13 of this Regulation, the procedure for approval) with the projects of cultural heritage protection zones indicated by the Ministry.

9. The mode of land use and the requirements for town planning regulations within the boundaries of the security zone, including the unified security zone, are established taking into account the following requirements:

a) the prohibition of the construction of capital construction projects, with the exception of the use of special measures aimed at preserving and restoring (regenerating) the historical, urban planning and (or) natural environment of the cultural heritage object (restoration, recreation, replenishment of partially or completely lost elements and (or) characteristics historical and urban planning and (or) natural environment);

b) limitation of overhaul and reconstruction of capital construction objects and their parts, including those concerning their sizes, proportions and parameters, the use of certain building materials, the use of color solutions, features of parts and small architectural forms;

d) preservation of town-planning (planning, typological, large-scale) characteristics of the historical, town-planning and natural environment, including all historically valuable town-forming objects;

e) ensuring the visual perception of the cultural heritage object in its historical, urban planning and natural environment, including the preservation and restoration of the ratio of open and closed spaces that has developed in the natural landscape;

f) compliance with the requirements in the field of environmental protection necessary to ensure the preservation of the cultural heritage object in its historical and landscape environment, as well as the preservation of the protected natural landscape;

g) other requirements necessary to ensure the preservation of the cultural heritage object in its historical and landscape environment.

10. The mode of land use and the requirements for town planning regulations within the boundaries of the zone of regulation of development and economic activity, including the unified zone of regulation of development and economic activity, are established taking into account the following requirements:

a) construction restrictions necessary to ensure the preservation of a cultural heritage object in its historical environment, including those concerning the size, proportions and parameters of capital construction objects and their parts, the use of certain building materials, the use of color schemes;

b) limitation of overhaul and reconstruction of capital construction objects and their parts, including those concerning their sizes, proportions and parameters, the use of certain building materials, the use of color solutions;

c) ensuring visual perception of a cultural heritage object in its historical, urban planning and natural environment;

d) restriction of economic activities necessary to ensure the preservation of a cultural heritage object in its historical, urban planning and natural environment;

e) preserving the quality of the environment necessary to ensure the preservation of the cultural heritage object in its historical, urban planning and natural environment;

f) compliance with the requirements in the field of environmental protection necessary to ensure the safety of a cultural heritage object in its historical and landscape environment, as well as a protected natural landscape;

g) other requirements necessary to ensure the preservation of a cultural heritage object in its historical, urban planning and natural environment.

11. The mode of land use and the requirements for town planning regulations within the boundaries of the protected natural landscape zone, including the unified protected natural landscape zone, are established taking into account the following requirements:

a) prohibition of the construction of capital construction facilities, restriction of economic activities, overhaul and reconstruction of capital construction facilities and their parts in order to preserve and restore the compositional relationship with the cultural heritage object of the natural landscape, including river valleys, reservoirs, forests and open spaces (except for works for the improvement of the territory and the placement of small architectural forms);

b) preservation of the quality of the environment necessary to ensure the preservation and restoration (regeneration) of the protected natural landscape;

c) preservation of the existing ratio of open and closed spaces in the protected natural landscape in order to ensure visual perception of the cultural heritage object in its historical, urban planning and natural environment;

d) compliance with the requirements in the field of environmental protection necessary to ensure the safety of a cultural heritage object in its historical and landscape environment, as well as a protected natural landscape;

e) other requirements necessary for the preservation and restoration (regeneration) of the protected natural landscape.

12. The project of the protection zones of the cultural heritage object, the project of the united protection zone of the cultural heritage objects are submitted to the relevant state authority together with the substantiating materials and the conclusion of the state historical and cultural expertise, as well as the results of public discussion.

13. On the basis of the project of protection zones (united protection zone) of a cultural heritage object of federal significance, recognized as a particularly valuable object of cultural heritage of the peoples of the Russian Federation or included in the World Heritage List, the Ministry of Culture of the Russian Federation in agreement with the Ministry of Construction and Housing and Communal Services of the Russian Federation in the presence of a positive conclusion of the state historical and cultural expertise and the conclusion of the relevant executive authority of the constituent entity of the Russian Federation, authorized in the field of state protection of cultural heritage objects, provided for in paragraph 3 of Article 34 of the Federal Law "On cultural heritage objects (historical and cultural monuments) of the peoples of the Russian Federation" , approves by its legal act the boundaries of the protection zones of the corresponding cultural heritage object, as well as the regimes of land use and the requirements for town planning regulations within the boundaries of these zones.

At the same time, the boundaries of the zones of protection of the cultural heritage object, as well as the regime of land use and the requirements for urban planning regulations within the boundaries of these zones, if they are located on the territory national park are subject to agreement with the Ministry of Natural Resources and Environment of the Russian Federation.

14. On the basis of the project of protection zones of a cultural heritage object of federal significance, a project of a united protection zone of cultural heritage objects, taking into account the presence of a positive conclusion of the state historical and cultural expertise, the relevant state authority of the constituent entity of the Russian Federation approves by a legal act agreed with the Ministry of Culture of the Russian Federation, the boundaries of the zones protection of a cultural heritage object (with the exception of the boundaries of zones of protection of a particularly valuable object of cultural heritage of the peoples of the Russian Federation or an object of cultural heritage included in the World Heritage List), regimes of land use and requirements for town planning regulations within the boundaries of these zones.

In order to coordinate with the Ministry of Culture of the Russian Federation the boundaries of the protection zones of the cultural heritage object, the modes of land use and the requirements for urban planning regulations within the boundaries of these zones, the executive authority of the constituent entity of the Russian Federation, authorized in the field of state protection of cultural heritage objects, submits to the Ministry of Culture of the Russian Federation:

project legal act on the approval of the boundaries of zones for the protection of cultural heritage sites, land use regimes and requirements for town planning regulations within the specified boundaries;

project of protection zones of the cultural heritage object;

information on the results of consideration of the projects specified in the first paragraph of this clause in the executive body of the constituent entity of the Russian Federation, authorized in the field of state protection of cultural heritage objects;

conclusion of the state historical and cultural expertise.

15. On the basis of the project of protection zones of a cultural heritage object of regional or local (municipal) significance, taking into account the presence of a positive conclusion of the state historical and cultural examination of the boundaries of protection zones of the corresponding cultural heritage object, land use regimes and requirements for town planning regulations within the boundaries of these zones are approved by a legal act the state authority of the constituent entity of the Russian Federation in the manner prescribed by the law of the constituent entity of the Russian Federation, on the territory of which this cultural heritage object is located.

16. Information about the boundaries of the protection zones of the cultural heritage object, the united protection zone of the cultural heritage objects should contain textual and graphic descriptions of the location of the boundaries of the protection zones of the cultural heritage object (in the form of a map (diagram) of the boundaries), a list of coordinates of the characteristic points of these boundaries in the coordinate system, established for the maintenance of the state cadastre of real estate.

Information on the boundaries of the protection zones of the cultural heritage object, on the restrictions on the use of the immovable property located within the indicated boundaries is recorded in the state real estate cadastre in accordance with the legislation of the Russian Federation on the state real estate cadastre. The absence of the information specified in this paragraph in the state real estate cadastre is not a reason for non-compliance with the requirements for the implementation of activities within the boundaries of the protection zones of cultural heritage objects.

17. The state authority that approved the boundaries of the protection zones of the cultural heritage object (united protection zone), the regimes of land use and the requirements for town planning regulations within the boundaries of these zones, shall send within 7 days from the date of entry into force of the decision on the establishment of protection zones of the cultural heritage object a copy of the said decision to the relevant local self-government body of the city district or municipal district, on the territory of which the zones provided for by the said decision are located, for placement in information system ensuring urban planning activities.

The state authority that approved the boundaries of the protection zones of the cultural heritage object (united protection zone), the modes of land use and the requirements for urban planning regulations within the boundaries of these zones, in accordance with the rules for organizing document circulation, records and stores all received documents and materials related to the establishment of zones ...

18. Information on the approved boundaries of the protection zones of the cultural heritage object (united protection zone), modes of land use and requirements for urban planning regulations within these zones must be posted by the state authority that approved the boundaries of the protection zones of the cultural heritage object (united protection zone), in the federal state information system of territorial planning, and is also sent by it to the body cadastral registration to be included in state cadastre real estate.

The approved boundaries of the protection zones of the cultural heritage object (united protection zone), the modes of land use and urban planning regulations within the boundaries of these zones are necessarily taken into account and displayed in the documents of territorial planning, the rules of land use and development, documentation for the planning of the territory (if necessary, these documents are amended according to established order).

19. When referring an immovable property located within the territories of the united protection zone of cultural heritage objects to historical and cultural monuments, the previously approved boundaries of the protection zones of the cultural heritage object, land use regimes and town planning regulations within the boundaries of these zones are subject to the necessary clarification in the manner established clause 21 of these Regulations.

20. Capital construction objects located within the territories of cultural heritage protection zones, the limiting parameters of which do not correspond to the land use regimes or urban planning regulations established within the boundaries of these zones, are used in accordance with these land use regimes and urban planning regulations from the date of entry into force of the act state authority on the approval of zones of protection of cultural heritage objects, providing for the establishment of such regimes of land use and town planning regulations.

Reconstruction of these capital construction facilities and their parts can be carried out only by bringing such facilities into compliance with the land use regimes and urban planning regulations established within the boundaries of the protection zones of the cultural heritage object, or by reducing their inconsistency with the established limit parameters of the permitted construction.

Regimes of land use and requirements for town planning regulations within the boundaries of protection zones of a cultural heritage object do not apply to legal relations related to the construction and reconstruction of capital construction objects that arose on the basis of construction permits issued in accordance with the established procedure before the entry into force of the legal act on the approval of zones protection of the object of cultural heritage.

21. Changes in the protection zones of a cultural heritage object, including their borders, land use regimes and urban planning regulations within the boundaries of these zones, is carried out by developing a new project for protection zones of a cultural heritage object (except for cases of correcting a technical error) in the manner established by this Regulation ...

A change in the unified protection zone, including its borders, land use regimes and town planning regulations within the boundaries of these zones, is carried out by adjusting only if the real estate object located within the territories of the united protection zone of cultural heritage objects is classified as historical and cultural monuments.

When the category of historical and cultural significance of a cultural heritage object is changed, the previously approved boundaries of the protection zones of this cultural heritage object are preserved and the regimes of land use and town planning regulations are in effect within the boundaries of these zones. If necessary, changes in the protection zones of such a cultural heritage object and their approval are carried out in the manner prescribed by this Regulation.

22. Compliance with the regimes of land use and town planning regulations within the boundaries of the zones of protection of cultural heritage objects is mandatory in the implementation of town planning, economic and other activities. Deviations from the land use regimes and town planning regulations established within the boundaries of cultural heritage protection zones are not allowed.

23. If an object of cultural heritage is excluded from the unified state register of cultural heritage objects (historical and cultural monuments) of the peoples of the Russian Federation, as well as its relocation, the decision to approve the boundaries of its protection zones, land use regimes and requirements for town planning regulations within the boundaries of these zones becomes invalid in relation to this cultural heritage site.

In case of exclusion from the unified state register of cultural heritage objects (historical and cultural monuments) of the peoples of the Russian Federation of a cultural heritage object located within the boundaries of the united protection zone, or its relocation, the land use regime and town planning regulations approved within the boundaries of this zone are established within the territory of the excluded or a displaced cultural heritage site.

If the cultural heritage object located within the protection zone of another cultural heritage object is excluded from the unified state register of cultural heritage objects (historical and cultural monuments) of the peoples of the Russian Federation, the regime of land use and town planning regulations, approved within the boundaries of this zone, are established within the territory of an excluded or displaced cultural heritage site.

When a decision is made to refuse to include in the unified state register of cultural heritage objects (historical and cultural monuments) of the peoples of the Russian Federation, the identified cultural heritage object located within the boundaries of the protection zone of the cultural heritage object, within the territory of such an identified cultural heritage object, the regime of land use and urban planning are established regulations approved within the boundaries of this zone.

24.
