ON THE FEDERAL SUPERVISION SERVICE IN THE FIELD OF RIGHTS PROTECTION

CONSUMERS AND HUMAN WELL-BEING

I. General Provisions

1. The Federal Service for Supervision of Consumer Rights Protection and Human Welfare (Rospotrebnadzor) is a federal body executive power carrying out the functions of developing and implementing public policy and legal regulation in the field of consumer protection, the development and approval of state sanitary and epidemiological rules and hygiene standards, as well as on the organization and implementation of federal state sanitary and epidemiological supervision and federal state supervision in the field of consumer protection.

2. The Government of the Russian Federation is in charge of the activities of the Federal Service for Supervision of Consumer Rights Protection and Human Welfare.

The Federal Service for Supervision of Consumer Rights Protection and Human Welfare is guided in its activities by the Constitution of the Russian Federation, federal constitutional laws, federal laws, acts of the President of the Russian Federation and the Government of the Russian Federation, international treaties Of the Russian Federation, acts of the Ministry of Health of the Russian Federation, as well as these Regulations.

5.1.4. sanitary and quarantine control at checkpoints through state border Russian Federation;

5.1.7. federal state supervision over the quality and safety of flour, pasta and bakery products when importing (exporting) the specified products to the territory of the Russian Federation;

5.1.8. state control for compliance with the requirements for the inclusion of information on the energy efficiency class of the product, other mandatory information on energy efficiency in technical documentation attached to the product, in its labeling, applying such information to its label, as well as the rules for including (applying) the specified information;

5.1.9. state control over the compliance of information products sold to consumers with the requirements of the legislation of the Russian Federation in the field of protecting children from information harmful to their health and (or) development, in terms of indicating in the accompanying documents for information products information obtained as a result of the classification of information products, and also placing, in accordance with the specified information, a sign of information products in compliance with the requirements technical regulations;

5.2. carries out licensing of certain types of activities within the competence of the Service in accordance with the legislation of the Russian Federation;

5.3.1. for the first time introduced into production and previously unused chemical, biological substances and preparations made on their basis, potentially dangerous to humans (except medicines);

5.3.2. certain types products representing potential danger for humans (except for medicines);

5.3.3. certain types of products, including foodstuffs imported to the territory of the Russian Federation for the first time;

5.3.4. persons affected by radiation exposure and exposed to radiation exposure as a result of the Chernobyl and other radiation disasters and incidents;

5.3.5. goods if they are included in section II of the Unified list of goods subject to sanitary and epidemiological supervision (control) for customs border and the customs territory of the Customs Union, as well as in cases stipulated by the technical regulations of the Customs Union;

5.4. establishes the causes and identifies the conditions for the occurrence and spread of infectious diseases and mass non-infectious diseases (poisoning);

5.5. informs the authorities state power The Russian Federation, state authorities of the constituent entities of the Russian Federation, local self-government bodies and the population on the sanitary and epidemiological situation and on the measures taken to ensure the sanitary and epidemiological well-being of the population;

5.6. prepares proposals on the introduction and cancellation of restrictive measures (quarantine) on the territory of the Russian Federation, constituent entities of the Russian Federation in the manner prescribed by the legislation of the Russian Federation;

5.7. organizes, in accordance with the established procedure, the conduct of social and hygienic monitoring;

5.8. organizes the activities of the system of the state sanitary and epidemiological service of the Russian Federation;

5.8 (1). carries out the development and approval of state sanitary and epidemiological rules and hygienic standards, as well as the development of mandatory requirements in the field of consumer protection;

5.8 (2). submits projects to the Government of the Russian Federation federal laws, regulatory legal acts of the President of the Russian Federation and the Government of the Russian Federation and other documents that require a decision of the Government of the Russian Federation on issues related to the scope of the Service, established by paragraph 1 of these Regulations;

5.9. checks the activities of legal entities in accordance with the established procedure, individual entrepreneurs and citizens on compliance with the requirements of the legislation of the Russian Federation in the field of ensuring the sanitary and epidemiological well-being of the population and in the field of consumer protection, as well as technical regulations, state control (supervision) over compliance with the requirements of which is entrusted to the Service;

5.10. performs the functions of the main manager and recipient of funds federal budget in terms of funds provided for the maintenance of the Service and the implementation of the functions assigned to it;

5.11. ensures, within its competence, the protection of information constituting state secret;

5.12. organizes the reception of citizens, ensures the timely and complete consideration of citizens' appeals, makes decisions on them and sends responses to the applicants within the time period established by the legislation of the Russian Federation;

5.13. provides mobilization training of the Service, as well as control and coordination of the activities of organizations under its jurisdiction for their mobilization training;

5.13 (1). organizes and maintains civil defense in the Service;

5.14. organizes vocational training staff of the Service, their retraining, advanced training and training;

5.16. interacts in accordance with the established procedure with public authorities foreign states and international organizations in the established field of activity;

5.18. performs other functions in the established field of activity, if such functions are provided for by federal laws, regulatory legal acts The President of the Russian Federation or the Government of the Russian Federation.

6. The Federal Service for Supervision of Consumer Rights Protection and Human Wellbeing, in order to exercise its powers in the established area of ​​activity, has the right to:

6.2. give legal and individuals clarifications on issues within the competence of the Service;

6.4. involve scientific and other organizations, scientists and specialists in accordance with the established procedure to study the issues of the established field of activity;

6.5. to suppress the facts of violation of the legislation of the Russian Federation in the established field of activity, as well as to apply provided by law Of the Russian Federation measures of a restrictive, preventive and preventive nature, aimed at preventing and (or) eliminating the consequences of violations by legal entities and citizens of mandatory requirements in the established field of activity;

7. The Federal Service for Supervision of Consumer Rights Protection and Human Wellbeing is not entitled to carry out in the established area of ​​activity legal regulation, except for the cases established by decrees of the President of the Russian Federation and decrees of the Government of the Russian Federation, as well as management state property and the provision of paid services.

The restrictions on the powers of the Service established by the first paragraph of this clause do not apply to the powers of the head of the Federal Service for Supervision in the Field of Consumer Rights Protection and Human Welfare in managing property assigned to the Service on the basis of operational management, solving personnel issues and issues of organizing the activities of the Service.

III. Organization of activities

8. The Federal Service for Supervision of Consumer Rights Protection and Human Welfare is headed by a head appointed and dismissed by the Government of the Russian Federation.

The head of the Federal Service for Supervision of Consumer Rights Protection and Human Welfare is the chief state sanitary doctor of the Russian Federation.

The head of the Federal Service for Supervision of Consumer Rights Protection and Human Well-being bears personal responsibility for the implementation of the functions assigned to the Service.

The head of the Federal Service for Supervision of Consumer Rights Protection and Human Welfare has deputies appointed and dismissed by the Government of the Russian Federation on the proposal of the head of the Service.

9. Head of the Federal Service for Supervision of Consumer Rights Protection and Human Welfare:

9.1. distributes duties between his deputies;

9.2. submits, in accordance with the established procedure, to the Government of the Russian Federation:

9.2.2. proposals on the maximum number and payroll of employees of the central office and territorial bodies of the Service;

9.2.4. proposals for the placement of territorial bodies of the Service;

9.2.5. draft annual plan and forecast indicators of the Service's activities, as well as a report on their implementation;

9.2.6. proposals for the creation, reorganization and liquidation of organizations under the jurisdiction of the Service;
