Registration of a newborn child: rules, terms, laws, fines. What documents are required to register a child in an apartment? What documents are needed to register a child Help that the child is not registered with the mother

The birth of a baby is a very important, significant and long-awaited event for every responsible and generally normal family. However, this moment entails not only new joyful emotions, interesting purchases and incomparable impressions, but also some inconveniences of a purely bureaucratic and formal nature. An example of such procedures is the registration of a newborn.

In the absence of the necessary knowledge regarding the procedure for registering a child and solving related problems, this event can cause a lot of trouble for young parents and take an enormous amount of their time. Legislative standards set a specific period during which a newborn must be registered at his place of residence - 1 month. Deliberate delay in registration can be regarded by the legislator as an administrative offense subject to punishment in the form of fines.

After reviewing the information below, you will find out what documents need to be prepared for registration of a newborn baby's registration, in what order the registration of a small citizen at the place of residence is carried out and why this is generally needed.

There are a number of significant differences between the mentioned events. Firstly, the registration process of a small child is not tied to any standards of the housing code in relation to other persons living in the territory of the real estate in question - registration of the place of residence of a newborn has a number of individual nuances regulated by its own state acts and regulations.

Secondly, a young child who has recently been born can be registered only at the address of residence of one of his parents or other legal guardians. There is no need to obtain prior consent for the registration of a child from persons living in an apartment or house.

If the child is registered at the dad's place of residence, provided that there is no record of the father in the birth certificate or other official confirmation of the fact of paternity, the registration procedure at the local representative office of the Multifunctional Center (or another body with the powers in question, if local authorities have established their own procedures) must both parents appear (if the mother is not officially recognized as deceased / missing / incapacitated, etc.). If the child is registered at the mother's residence address, the father does not need to be present during the event.

Many parents are interested in: is it necessary to register the child anywhere at all, because with regard to newborns, there are usually many other more important and significant matters that take up a significant amount of time? The answer is unequivocal: the child needs a residence permit.

Exclusively after registration of the place of residence of a small citizen, the child and his parents have the opportunity to use the rights and privileges provided at the national and local levels. For example, only after the registration of the newborn will it be possible to issue a monthly cash allowance, maternity capital, a health insurance policy for the baby, etc. In addition, without registering a child, it will not be possible to apply for a kindergarten and even sign up for a queue for admission to this preschool institution on a legal basis. That is why parents should promptly resolve the issue of registration of a newborn - this is in their own interests.

In general, the procedure for registering a child is much simpler and faster than a similar procedure for an adult. The only point: you need to take the most responsible approach to the process of collecting the required documents and certificates, so as not to waste extra time on preparing the missing papers in the future.

Where can a child be registered by law?

The provisions of the current legislative standards establish a number of rules, the observance of which is mandatory in relation to the registration process of a newborn. For greater ease of perception, information on this matter is framed in the format of the most popular questions and answers to them, and is presented in the form of a table.

QuestionAnswer
What are the procedures established for the registration of a child with parents?If the parents of the baby live together and are registered on the same living space, no additional questions usually arise, and the newborn is registered at the same address.

In the case of separation of parents (for example, after a divorce) or their registration in different places, the child is registered at the residence / registration address of one of the parents. If the parents are divorced, registration is usually issued at the place of residence of the parent with whom the baby continues to live. If citizens are simply registered at different addresses, they independently agree on the most optimal option for registering the baby's place of residence.

Important! If a man is not entered in the baby's birth certificate as a father and in the absence of other legal evidence of the fact of paternity, the child will not be registered with him.

In the case of separate residence of the parents, the mother of the baby does not have to obtain the consent of the child's father for registration. The father, in order to register the baby at home, will have to obtain such permission in advance.

Where will the child be registered if he has no parents?If the child is in a specialized institution, this issue will be decided by the administration of that institution.

If the child has a legal guardian, the newborn can be registered at the place of residence of the latter.

Can a child be registered with grandparents or other relatives?With living parents who have not been deprived of their rights in relation to the child in court, no.
What if the parents live separately and cannot agree on whom to register the child with?In such situations, you often have to go to court. In general, practice shows that it is better for parents to try to come to a mutually satisfying decision on their own, because legal proceedings under any circumstances take a lot of time, effort and nerves.

The list of required securities includes quite a few items. To avoid unnecessary time-consuming re-standing in queues when you find a shortage of any help, thoroughly prepare for the upcoming process:

  • study the list of documents below, or better - first specify the composition of such in the place, tk. legal provisions may also vary slightly in different regions;
  • make copies. The number of these may differ in relation to different documents. In order not to miscalculate, prepare 3 copies each - even if the employee of the Multifunctional Center does not need such a number of copies, they will definitely come in handy in the future. This will save you twice the time.

The length of the registration process may vary from agency to agency. On average, this event takes several days. Upon completion of the necessary actions, the passport officer will return the parents of the baby their passports and originals of other submitted documents.

In accordance with the provisions of the current Russian legislation, the fact of registration of a minor of their citizens is confirmed by a corresponding certificate. However, the authorized authorities often ignore this provision, dispensing with a stamp on the birth certificate. Such an action is not entirely lawful, therefore, parents have every right to demand the issuance of the mentioned document.

The need to pay the state fee and other encumbrances in the process of registering the place of residence of a small child has not been established - the procedure is carried out free of charge.

Important! When submitting documents for consideration by an employee of the passport service, at the same time ask for a certificate confirming the fact of the baby's residence with his parents. This document is included in the package required when applying for child support. This way you will avoid the need for a separate separate appeal to the passport office and save time.

Thus, although the process of registering the place of residence of a newborn is quite lengthy and exhausting, it is necessary to try to deal with this problem as soon as possible - best of all, before the child reaches 1 month of age, because in such circumstances, you will have to prepare one less document, which, albeit a little, but makes the task easier.

The decision to register a child has an important impact on the rest of his life.

Registration of a child has several nuances, accounting for which will help to avoid problems in the future. So, if the apartment is owned by the municipality, it will be much easier to privatize it without the children registered in it.

Registration of a child with one of the parents

Registration of a minor under the age of 18 at the place of registration of one of the parents presupposes their separation. To formalize such a procedure, a prerequisite is obtaining the consent of the second parent. If the representatives cannot voluntarily decide with whom to register, the decision can be made by the court based on the wishes, and in the interests of the child.

How to register a minor child at the place of official registration of the biological father. Is mother's consent required

When registering a newborn or minor citizen, it is worth remembering that if the persons have not registered their relationship, and the man does not submit papers to the registry office to confirm the fact of his paternity, then the child will not be able to be registered at the citizen's address, since the law determines the place of registration in the apartment of residence of legal representatives.

Registration of the child with the father in this situation will be carried out only on the basis of a court decision that has entered into legal force on the recognition of paternity.

To register a child in a home that is not owned by the parents, it is not required to obtain the written consent of all owners. Registration of a child at the place of permanent residence of the legal father can be carried out only with the written permission of the mother.

How to register / register a child at the declared place of registration of the mother

The main condition for the registration of the child at the place of residence of the mother is the presence of a birth certificate. If the registration of a child is made at birth, the time frame for the first registration of an infant is not legally established, but experts recommend doing this within a month.

When registering for a newborn, during this period, a statement written by the mother will be enough, and there is no need for the father's permission. If this deadline is missed, it is required to obtain a certificate from the housing office from the father's place of residence, as well as obtain his consent to carry out such actions.

What documents are needed to register a newborn

The package of documents required for registering a citizen under the age of 18 will vary depending on the legal status of his legal representatives.

For legally married parents, you must provide the registrar with:

Where can you go to register a child?

Documents for registration of a newborn can be submitted to one of the following authorities to choose from at your discretion:

Registration at any authority is exempt from the need to pay state duties and taxes, and is absolutely free.

Term of circulation

The deadlines for applying for the registration of a newborn child are not established by law. In the case of re-registration, the child must register for permanent registration within 7 days after being discharged from the previous place of residence, and with temporary registration in the period up to 90 days after settling in the place of residence of the parents.

Who should prescribe the baby?

The presence of specific citizens will differ depending on the situation in which the child is prescribed:

  • at the birth of a child. During the first month after the fact of birth, it is enough for only the mother to come to the registrar; documents can be made by providing a minimum set of documents. If she cannot appear, the procedure can be carried out at the place of residence of the biological mother at the request of the father. Further, the obligatory presence of two parties is required;
  • parents are divorced or have a formalized union. In such a situation, in order to make the registration, it is necessary to appear to both the father and mother to draw up an application. If the parent, who has given consent to such actions, cannot be present at the registrar for valid reasons, it is necessary to make consent with a notarized apostille;
  • if the parents live together and have a registered marriage certificate,

In all moments in the presence of a minor, all owners living in the apartment are not necessary.

Your baby was born! After being discharged, you will be awaited not only by the joy of being with the baby, but also by the need to issue the necessary documents for him. Perhaps you have already faced the question: "How to register a child in an apartment?"

Where should you go? What documents do you need to register a newborn? Where can I find out if it will be possible to register it in this house? What are the advantages of registering a child in an apartment? Can my father do paperwork? And, perhaps, you doubt whether he needs a residence permit? We have prepared for you answers to these difficult questions of concern to parents, considered what difficulties arise when registering a newborn in an apartment and compiled a list of necessary documents. Let us first turn to the list of required papers.

This is your child's first document. To obtain it, you need to contact the registry office at your place of residence. To issue a birth certificate, you need to present a certificate from the hospital, a photocopy of the passport of one of the parents (along with the registration page in the apartment at your place of residence) and a marriage certificate. You can submit papers to both mother and father. The deadline for obtaining a birth certificate is determined by law. This must be done in the first month of the baby's life.... You receive it in the same registry office at your place of residence, where the documents were submitted. If you do not do this on time, then you will need to pay a fine of a little over two thousand. If the birth certificate of your baby is written in a foreign language, then in order to register a newborn, it must be translated into Russian. After that, it should be certified by a notary at the embassy.

Application for registration according to form No. 6

The form will be given to you at the passport office for your place of residence. It is filled in by the parent to whom the newborn is registered in the apartment. In the application, you will need to indicate the number of the certificate for the apartment where you plan to register the newborn. You can find out all the necessary data by submitting an application to the EIRTS.

Mother and father passport

If the parents' marriage is officially registered, then you can submit a document of one of them. If the marriage is not formalized, as well as single mothers, you can limit yourself to your passport.

Photocopies of all documents

We advise you to make copies of all papers in several copies. They will not be needed this time, it is imperative that some of them will be useful somewhere else. Otherwise, the employees of the passport office may refuse to accept them. It is better to keep all papers in a folder for documents, then you may be able not to lose anything and not forget the necessary documents. Make sure copies are of good quality, readability and legibility are very important.

Consider what cases are possible when registering

The set of papers depends on two factors: where you are going to register the baby, and where you yourself are registered.

Mother and father are registered in the same apartment

In this case, there will be no difficulties with registration in the apartment. You need to bring the above papers to the passport office of your home. If the parents live by legal marriage and paternity is confirmed, then one of them can provide documents at his place of residence.

Only mother is registered in the apartment

If they want to register the child in the mother's apartment, then there will be no difficulties. You just need to bring a standard set of documents to the passport office related to your place of residence.

Only the father is registered in the apartment

Then, in addition to the standard set of papers, a statement from the mother is required, confirming the consent to register the baby with the father in the apartment.

Parents are not registered on the living space, but they want to register the child there

According to article 20 of the Civil Code of the Russian Federation, a minor can only live with his mother or father. Therefore, one of the parents will have to check out from another apartment and register for a new living space. If this condition is met, it will be possible to register your baby in it.

Parents want to register the child with the grandmother in the apartment

As mentioned above, the minor must live with the mother or father. You will not be allowed to register a newborn with grandparents in an apartment if the parents are not registered there. Therefore, if it is essential to register the child there, then, first of all, it is necessary to give up parental rights and appoint the grandmother as a guardian. Then she will be able to draw up all the documents at her place of residence herself.

Parents are registered in an apartment that is located far from their place of residence, and they want to register a newborn there

This does not contradict the law and therefore is possible. You need to go there yourself and arrange the paperwork on the spot. The situation is simplified if the mother and father have the same registration address. Then one of them can take over the registration. Sometimes the employees of the passport office can get into a position and agree to issue a residence permit by power of attorney written by the mother in the name of the grandparents. To find out if this is possible, call the passport office first.

Important to remember:

  • You can register a child without the consent of the owner of the apartment and the others living in this living space;
  • A newborn under one month old only needs a statement from his mother for registration;
  • After one month, the registration of the newborn will require a statement from the mother and a certificate of family composition from the father's place of residence (if the parents live separately). If the baby is prescribed to the father, then a statement is required from him in the form No. 6. The mother needs to write a statement that she agrees to register the child not with her, as well as submit a certificate of the composition of the family from her place of residence;
  • The registration procedure for a newborn is free;
  • The law does not establish the period during which the child must be registered in the apartment. However, part 2 of article 19.15 of the Code of Administrative Offenses for living without a residence permit provides for a penalty in the form of a fine (from 2,000 to 2,500 rubles). The internal affairs bodies often use this article to punish negligent parents who drag out the prescription of the baby at the place of his stay;
  • If the parents live separately from each other, then for the registration of the child to one of them, the permission of the other is required;
  • You can register a baby on any living space, even if it is small;
  • If the parents live in an unregistered marriage and the newborn is registered with the father, then both mother and father must be present when submitting papers;
  • The registration procedure takes no more than a week. You will receive documents at the same passport office at the place of your registration where you submitted them;
  • All papers are fed at once.

Why do you need a registration?

  1. To confirm the rights of the child as a citizen of the Russian Federation. Now he can use all social services on an equal basis with others;
  2. To get a compulsory health insurance policy. Without him, the clinic will not make an appointment with a doctor. And babies under one year old need to be checked by all specialists and get all the necessary vaccinations;
  3. To receive child support. In the social protection authorities, where you will go for benefits, the registration certificate is on the list of documents required for registration;
  4. To get maternity capital. At the pension fund where you come to apply for this payment, you will need to provide registration information.

So, let's summarize. It is better not to delay the registration of registration and to cope with a month after the birth of the baby. In this case, you will need only three documents and their copies. All papers are handed over to the passport office at your place of registration, and a week later you will receive your passport and your child's birth certificate, which will bear a registration stamp.

If more than a month has passed since birth, then two more papers will be required from the father or from the mother. Do not delay the paperwork, but also call the information department of your passport office and specify which papers are needed in your case.

You can notify the state that a new citizen has been born on its territory by registering at the place of residence. To do this, you should know what documents are needed to register a newborn.

It is imperative to register a newborn child at the place of registration. This point is enshrined in federal law. When a child is born, he almost always receives Russian citizenship automatically.

He has certain rights. And also some responsibilities apply to him with age. The first of these is the preparation of the necessary documentation.

This responsibility is provided by the father and mother of the newborn. It is advisable to do this in the first few weeks after the child has appeared in the family.

Registration is required even when the parameters of the apartment do not allow it. The form of the real estate does not matter. The premises can be communal or privatized. The type of real estate also does not matter.

Registration in a non-residential area is not possible.

The procedure is carried out in a specific order. The queues for registration can be very long.

Why is it needed

A new family member needs a residence permit. Registration is required:

  1. Registration of the compulsory medical insurance policy.
  2. Registration of social benefits for a child.
  3. Receipt of maternity capital.
  4. Determining a child in a preschool institution.

The policy is required for service in the clinic. There you are required to present a photocopy of it. It is impossible to place a child in a kindergarten or school without this paper. Children's registration is one of the most important certificates when receiving benefits.

What are the nuances

Sometimes it becomes necessary to register a child without the consent of the owner. This can be done when one of the parents is registered in the living space himself. This is evidenced by the Family Code of the Russian Federation.

A newborn baby can only be registered with parents

The same applies to situations when it becomes necessary to register a child in a municipal apartment. In this case, only the father's or mother's registration may be required.

You cannot register a new family member with friends and grandparents.

Registration of a newborn child in a separate property is prohibited. This applies even when the infant is the owner of the living space. The Russian Family Code does not provide for the separation of minors, his father and mother.

What are the rules

Registration for a newborn is made in accordance with the following rules:

The optimal time for preparing and submitting all certificates is 7 days after receiving a birth certificate.

If the parents are married

A newly born child can be registered 24 hours in advance. To do this, you need to submit the necessary documents.

Children are prescribed in accordance with the following order:

  • obtaining a baby's birth certificate;
  • going to the passport office;
  • drawing up an application for registration;
  • obtaining a birth certificate with a stamp put on it.

Hike to the registry office

You can get a birth certificate at the district office. The parents of the baby are provided with the following papers:

  1. Russian passports.
  2. Help from the maternity hospital.
  3. Certificate of official registration of the marriage union.

If the parents have not received the child's birth certificate even after 30 days, a warning may be sent to them.

Hike to the passport office

Parents fill out an application form No. 6. Forms are provided by the staff of this institution. and can be downloaded from our website.

A sample application for registration can be seen on the information board. Together with the application, the collected papers are provided. The list of documents for registration of a newborn includes:

A document confirming the state of the personal account of the place of registration can be taken from the accounting department of the organization.

Documents for registration of a newborn are provided in one day.

Registration times vary from 24 hours to 1 week.

To mother

You can register a child at the place of registration of the mother using the following documents:

It is also allowed to provide an extract from the USRN. If the mother lives in a municipal apartment, the provision of a social employment contract is allowed.

To the father

Both parents need to come to the registration of a newborn child at the father's place of residence.

The father and mother write a separate application to register the baby. The father needs to draw up an application in the form No. 6, the mother - an application for the registration of the baby at the place of residence of the spouse.

The list of documents for registration of a newborn with a father includes the same papers that are required for registration with a mother.

If the father does not confirm his paternity in the registry office, then it is impossible to register the newborn with him. This is due to the fact that legally the infant does not have a father.

To legal representatives

You can register a newborn child with guardians or legal representatives. This is true when the baby is left without a father and mother.

You can register a newborn child with guardians or legal representatives

You can register a baby without the consent of the persons registered in the room. This is true even when the legal representatives are not the owners of the living space. The main criterion is legal residence.

All disputes about the registration of an infant can only be resolved in court.

Things to Remember

A person who has planned a permanent residence permit for a new family member must be present in the unit of the service responsible for migration.

If the spouses who are not divorced do not live together, the baby's mother cannot register him at the father's place of permanent residence without obtaining his consent to this.

Mothers will be denied registration of the child at the father's place of residence, without his consent

Do not trust those people who say that you have to pay for registration. The infant is prescribed free of charge. There are no additional state duties and taxes.

The Russian will need to pay only if he needs any additional services. And also notary services are additionally paid.

If, upon the solution of the issue, violations were noticed on the part of the employees of the migration service, the parents have the right to go to court with a statement of claim.

Privatized or municipal

There is no significant difference. The consent of those who own the dwelling is not required.

But in some divisions of registration, at the request of employees, permission is granted from the owners of privatized housing. In order to avoid problems, this issue must be clarified in advance.

An infant registered in a privatized dwelling may in the future receive property rights. Deals with the living space due to his registration may become more complicated.

Alleged sanctions

If the deadlines have expired, and the baby is still left without permanent registration, his parents face penalties.

For untimely registration of a newborn, a fine of 1.500 rubles is threatened

The amount of the fine is regulated by Russian law. In 2017, the amount of punishment for negligent parents is 1,500-2,500 rubles.

Where to contact

To register a newborn child, you can contact:

  1. Home housing department.
  2. The territorial subdivision of the service responsible for migration.
  3. Territorial division of the MFC.

And it is also allowed to resolve this issue through the State Services.

Contacting the MFC

This method is one of the most convenient. The working hours of the specialists are quite flexible. All documents are submitted at the same time. Get help in the same window.

It is easier to get to the multifunctional center than to the FMS or the passport office. The employees of this organization are ready to offer consulting services.

Registration and other documents can be obtained from the MFC

The main goal of a multifunctional office is to relieve the burden of civil servants from the flow of documents. All data is sent to the FMS. The registration procedure is carried out there. Then the papers are returned to the office, after which the Russian can receive them.

To apply through the MFC, you must:

  1. Prepare documentation.
  2. Check all papers for compliance and correctness.
  3. Bring the assembled package to the center unit.
  4. Fill out an application.
  5. Accept a receipt from the center specialist.
  6. Clarify the date of the return visit to the MFC.
  7. Get a finished document.

The procedure is somewhat different from the standard one, but its essence remains unchanged.
