Yes, you can refuse. There is no parental responsibility for refusing vaccinations. In Art. 11 of the Law "On Immunoprophylaxis of Infectious Diseases" directly indicates this possibility.

The article is titled "Requirements for Prophylactic Vaccinations" and indicates the conditions for the procedure:

The institution that carries out this activity has a license.
The person who will be vaccinated has no contraindications to it (the list of contraindications is approved by a special order).
Vaccination is carried out in compliance with the established sanitary rules.
There is informed voluntary consent of the patient for medical intervention. For minors under 15 years of age, the consent of one parent / legal representative is required. If a child suffers from drug addiction, then parental permission is required until he reaches the age of 16.

How to refuse preventive vaccination? Is there a pattern for such a refusal?

The sample was approved by a special Order of the Ministry of Health and Social Development of January 26, 2009 under N 19n. This is what the consent / refusal form looks like:

Is there an article of the Criminal Code for compulsion to vaccination? What if the hospital forces you to sign a vaccination consent?

There is no legal liability yet for refusing vaccinations for parents / legal representatives. But the doctor / institution that gave the vaccine (= medical intervention) can get serious problems.

Administrative liability for lack of consent to vaccination is provided for by the following rules:

Article 6.3 for violation of legislation in the field of ensuring sanitary and epidemiological well-being. This will result in a fine of up to 20,000 rubles, suspension of activities for up to 90 days (for a legal entity), or a fine of up to 1,000 rubles for an official.
Article 6.7 for violation of sanitary and epidemiological requirements for the conditions of recreation and health improvement of children, as well as their upbringing and education. A fine of up to 120,000 rubles and suspension of activities for periods of up to 90 days (for legal entities).

Medical intervention without consent is criminalized:

Section 235 for illegal medical or pharmaceutical activities (without a license).
Section 236 for violation of sanitary and epidemiological rules, which, by negligence, led to mass diseases, poisoning (according to part 1) or death of a person.
Section 237 for hiding information about those circumstances that create a danger to the life or health of people (may be drawn to this situation).
Section 109 for causing death by negligence or Art. 105 for murder.
Section 111 for intentional infliction of grievous bodily harm.
Section 112 for intentional infliction of moderate harm to health.
Section 118 for causing grievous bodily harm through negligence.
Section 115 for deliberate infliction of slight harm to health and others.

What is "coercion to vaccinate"? What is this article of the Criminal Code?

Legislatively in Russia, some consequences of refusal of vaccinations are established:

Namely, in accordance with Part 1 and Part 3 of Article 20 of Law No. 323-FZ "On the Protection of Citizens' Health", a prerequisite for medical intervention is the giving of informed voluntary consent of a citizen or his legal representative to medical intervention on the basis of a complete information about the goals, methods of providing medical care, the associated risk, possible options for medical intervention, its consequences, as well as the expected results of medical care. A citizen, one of the parents or another legal representative of a person has the right to refuse medical intervention or demand its termination.

That is, on the basis of these norms, the child's parent has the right to refuse any vaccination, while writing a written refusal of vaccinations, both when passing the medical commission to a kindergarten or school, and in the process of a child visiting a kindergarten or school at any stage. At the same time, no honey. the employee does not have the right to demand from you any additional certificates or documents, and even more so to demand any kind of vaccination. These actions are illegal, thus giving rise to the legal liability of the person who made the unlawful decision.

In addition, it is important to note that the decision to refuse to admit a child to an educational institution (kindergarten or school) can only be made in writing: in the form of a refusal (order or decision) for newly admitted children, as well as in the form of an order to remove the child from visiting a kindergarten or school for children already attending an educational institution.

This order or other administrative document can only be signed by an official, that is, the head of the kindergarten or the director of the school. For example, no honey. a nurse or doctor has no right to make such a decision, since they are not officials. In addition, such an order must contain legal grounds, namely the norms of the law, according to which the child is excluded from attending an educational institution or is not allowed to attend (for newly admitted children). By the way, such norms simply do not exist in relation to this situation. An order signed by an official can be appealed in court or by sending a complaint to the Prosecutor's Office.

From my own experience I can say that neither the head of the kindergarten, nor the headmaster of the school will agree to this, since such a decision is illegal and violates the child's right to education, provided for by the current Constitution (Article 43), as well as the Law on Education. In accordance with Article 5 of Law No. 273-FZ "On Education in the Russian Federation", the right to education in the Russian Federation is guaranteed, regardless of gender, race, nationality, language, origin, property, social and official status, as well as other circumstances.

In the event that by a decision of the court or the Prosecutor's Office the actions of an official are found unlawful, the said official is brought to administrative responsibility provided for by the Code of Administrative Offenses. The actions of this official are subject to Article 5.57 of the Code of Administrative Offenses of the Russian Federation, according to which the guilty official is subject to administrative liability. In view of the importance of this article on the responsibility of officials for the illegal refusal to admit a child to a kindergarten, school, as well as his illegal removal from educational activities, I cite this article in full.

Art. 5.57 of the Administrative Code of the Russian Federation establishes the following:

1. Violation or illegal restriction of the right to education, expressed in violation or restriction of the right to receive public and free education, as well as illegal refusal to enroll in an educational organization or expulsion (exclusion) from an educational organization - entails the imposition of an administrative fine on officials in the amount of from thirty thousand to fifty thousand rubles; for legal entities - from one hundred thousand to two hundred thousand rubles.

2. Violation or illegal restriction of the rights and freedoms of educational institutions provided for by the legislation on education, or violation of the established procedure for the implementation of these rights and freedoms - entails the imposition of an administrative fine on officials in the amount of ten thousand to thirty thousand rubles; for legal entities - from fifty thousand to one hundred thousand rubles.

3. The commission of an administrative offense provided for in part 1 of this article by an official previously subjected to administrative punishment for a similar administrative offense - entails disqualification for a period of one to two years.

Some parents ask if all these norms apply to private kindergartens and schools, because they are non-state. Answer: yes, they do, since any private kindergarten or private school, before operating, must obtain permission - a state license to conduct the relevant activity, therefore, they are subject to all legal requirements applicable to standard budget educational institutions.

How to write a refusal to vaccinate

Now a few words about how to file a refusal to vaccinate. The form of refusal can be arbitrary, however, there is an Order of the Ministry of Health and Social Development of the Russian Federation of January 26, 2009 N19n, in accordance with which the recommended form of refusal of vaccination is approved.
